Tribunal says Yes to Mimiko…Admits Exhibits
Words from Akure has it that the Tribunal has accepted and admitted Mimiko’s petition (evidence, including forensic reports) today (Monday). The ruling was supposed to have been made on Friday. This a major victory for Mimiko since it’s the foundation for the appeal.

The Election Petition Tribunal sitting in Akure, Ondo State, on Monday admitted all the documents totalling 1,069 pleaded as exhibits by the governorship candidate of the Labour Party (LP), Dr. Olusegun Mimiko.
The documents include the death certificate of a 300-level student of the Adekunle Ajasin University, Akungba Akoko, Waribi Idepe, who was allegedly killed in Ese-Odo on April 14 during the governorship election.
Supporters of the LP that were not privileged to enter the court room immediately went into jubilation as news filtered to them that the Justice Garba Nabaruma-led tribunal had admitted the documents.
The documents also include the Independent National Electoral Commission (INEC) manual, voters’ registers in the disputed areas, forms Ec8a, Ec8b and Ec8c.
The disputed areas are Ese-Odo, Ilaje, Okitipupa, Irele, Ile-Oluji/Okeigbo, Akoko North East, Akoko North West, Ose, Odigbo and Akure North.
The tribunal had adjourned ruling on the admissibility or otherwise of the documents till Monday at its sitting on Friday.
Supporters of the Peoples Democratic Party (PDP) and the LP had thronged the venue of the sitting with high expectation over the ruling.

Our God will deliver the sound judgement of Mimiko;s triumph which Obasanjo denied the people of Ondo State in April when He Obasanjo forcefully directed the declaration of falsity and lies in Abuja in April while Ondo State was yet to even complete the result compilation. Even then Mimiko already had won with a landslide victory. We all know this, even PDP knows this and by the Grace of God, the Tribunal will acknowledge this. I can feel my spirit jumping for joy already. Soon and very soon you faithful stalwarts for the truth and justice in Ondo State.

AKURE — THE Election Petition Tribunal sitting in Akure, the Ondo State capital, yesterday, admitted all the 1,069 documentary evidences presented by the Labour Party (LP) governorship candidate, Dr. Olusegun Mimiko, to aid his petition against the victory of Governor Olusegun Agagu in the April 14 election. But Governor Olusegun Agagu has said there is no cause for alarm over the tribunal’s ruling.
The ruling provoked wild jubilation as supporters of the governorship candidate of the LP trooped to the major streets in Akure singing and dancing thereby causing traffick logjam for hours.
While the ruling was being delivered, supporters of the LP had sent text messages to others that were not allowed into the premises of the tribunal and the atmosphere was charged following which two different groups emerged and both started singing the praises of their parties.
Security was tight at the State High Court, venue of the sitting of the tribunal as no fewer than thirty mobile policemen kept vigil while a Personnel Armoured Carrier, PAC, was stationed at a strategic position in case of any eventuality.
Delivering ruling which lasted for over one hour, the Chairman of the Tribunal, Justice Garba Nabaruma, said that all the documents were pleaded and relevant to the petition of Dr. Mimiko filed before the tribunal.
Nabaruma pointed out that “We have found out that all the documents are generally pleaded by the petitioner hence their acceptance by this tribunal”.
Documents accepted as exhibit from ten council areas of the state include INEC manual, voters card, certified true copies of returns, forms EC8A, EC8B , EC8C, EC8D, unused voters cards and the death certificate of one Waribi Idepe a 300-level Mass Communication student, an alleged victim of electoral violence in Ese Odo, local council area of the state.
The affected council areas include Irele, Ese Odo, Okitipupa, Odigbo, Ilaje, Ile Oluji/Okeigbo, Akure North, Akoko North West, Akoko North East and Ose.
It would be recalled Dr. Agagu failed in his bid to stop Dr. Mimiko from tendering the April 14 election results and other documents as evidence to prove his case against the incumbent.
I am sure from the news reaching us from Akure on the election tribunal sitting, political journalists and analysts interested in Ondo state politics will now be busy drafting the political obituary of Agagu. I do not have anything against him personally, but whoever ventures into politics, especially in my own state, and fails to deliver the goods deserve all the criticisms they get, and should have no truck with active politics.

And the waiting continues but we have no fear, for all is well that ends well. Ondo State deserves justice and Mimiko deserves vindication. We shall soon celebrate.
We thank God for the support and expectations of a verdict of Truth which we are all awaiting, which millions of people in Ondo State, Nigeria and the diaspora are giving and showing our Man of the people Dr Olusegun Mimiko. Grapevine news also has it that even many who have benefited and gained contracts worth Millions from Agagu are already backing down and nodding in assent that “Agagu is a gonner”. No offence meant but these people had better keep their false and fake love to themselves from now on and keep away from Labour Party and Dr Mimiko. The business at hand when Mimiko regains his mandate has nothing to do with corruption and milking the overmilked cow. Oh no, Room Enough for all involves working hard to restore the lost glory of Ondo State and seeing to the welfare of all in Ondo State and easing the “aches and pains” inflicted by Agagu on Ondo State.
Mimiko’s name is still being mentioned in the four corners of the world and all those who have shown interest and supported Mimiko to gain back his stolen mandate after the landslide victory (Mimiko 8, Agagu 2 data) are actually saying they cant wait for the verdict which they think is really taking long and should be anytime now.

OAUTH CMD, SSS director, HOS appear before Ondo tribunal

The Chief Medical Director of the Obafemi Awolowo University Teaching Hospital (OAUTH), Ile-Ife, Professor A. O. Adejuyigbe; the Ondo State Director of the State Security Services (SSS), Mr. Spero Jack; and the Head of Service (HOS), Ondo State, Mr. Alaba Isijola, on Wednesday appeared before the election petition tribunal sitting in Akure.
The Permanent Secretary, Establishment and Service Matters, Mr. Abiodun Alabi, also appeared before the Justice Garba Nabaruma-led tribunal at the resumed hearing of the petition filed by the governorship candidate of the Labour Party (LP), Dr. Olusegun Mimiko, challenging the declaration of Dr. Olusegun Agagu as the governor of the state at the April 14 governorship election.
However, the Resident Electoral Commissioner in the state, Alhaji Abubakar Hamadu, failed to honour the subpoena served on him by the tribunal.
While Isijola and Alabi appeared in person, the director of SSS was represented by the legal officer, Mr. Ahmed Musa, and Dr. Olukayode Arowolo represented Adejuyigbe.
Counsel for the governor, Mr. Adeniyi Akintola (SAN), had objected to the appearance of Arowolo on behalf of his boss, adding that he could not tender the referral letter from OAUTH to the University College Hospital (UCH), Ibadan, issued to Wabiri Idepe, who was allegedly killed during the election.
Akintola’s argument was based on the fact that the letter was not part of the document admitted as exhibits by the tribunal at its last sitting.
However, counsel for the petitioner, Chief Rotimi Akeredolu (SAN), said the position of the respondent was wrong as the letter was one of the documents pleaded and admitted by the tribunal.
And so the battle continues. A legal battle that will go down in history books and forever remembered by Ondo State. The end result is what we all focus on, for the world and Nigeria wants to see if at last Justice would be done and the wicked lying theiving Agagu is rightly judged and removed, period.
The fact is, justice can never be done until Mimiko is declared the Governor of Ondo State and handed back His Stolen Mandate.
We patiently await the end result.

PDP, Agagu allay fears over Mimiko’s documentary evidence.
GOVERNOR Olusegun Agagu of Ondo State and the Peoples Democratic Party (PDP) have said there is no cause for alarm over the ruling of the Election Petition Tribunal sitting in Akure which admitted 1,069 documentary evidence of the governorship candidate of the Labour Party (LP), Dr. Rahman Olusegun Mimiko.
Responding to the tribunal ruling, yesterday, the counsel to the governor and the PDP expressed surprise over the spate of jubilation which greeted the ruling that the documents were admissible.
The Justice Garba Nabaruma-led tribunal sitting in Akure on Monday admitted all the documents pleaded by Mimiko to be used as exhibit to prove his case at the tribunal.
Counsel to the PDP, Chief Ifedayo Adedipe (SAN), said the ruling had no negative implication on the party but a further confirmation that there was an election.
Also, counsel to the governor, Dr. Kayode Olatoke, said there was nothing unusual in the tribunal’s ruling.
“When we get to the bridge we shall cross it, we are not surprised at the ruling of the honourable tribunal because these are the same set of documents with which our client was declared, so the documents are themselves very useful to us in our case.
“Admitting documents is not the same thing as attaching probative value to them. Do these documents have probative value? That is the question we shall answer in the next few days. Our initial objection to the tendering of the documents is personal to us”.
PDP definitely have identified that there is cause for alarm by quickly trying to “allay fears” although pathetically. They must be feeling very jittery due to the mamouth jubilation of thousands who are awaiting the return of the mandate to the man they voted in as governor in the person of Dr Olusegun Mimiko. So there was election in Ondo State? We are not contesting this, the result declared after the election is what is questionable. This is why after all when the result comes out what we would be expecting is that Mimiko is declared winner and Agagu sent packing. There will be no question of having another election in Ondo State.
The problem with Agagu and his counsels and also his press/information officers is that they all sing the same song over and over like a broken record and are not tired of hearing themselves croak. But for those listening, its pathetic, a bore and shows they have nothing else to show for. Do they even believe themselves? I think not. So who would believe or reckon with them.
I thank God for all the millions of people worldwide who have stood and are still standing and will stand with Mimiko to the end. If PDP are jittery about Wednesdays jubilations, let them wait to hear the massive JUBILEE state when Mimiko’s stolen mandate is returned to him. God is in control and will bail Ondo State out of its present predicament in Jesus name. SOON AND VERY SOON. WE WAIT.

HOW MUCH LONGER FOR THE TRUTH TO BE REVEALED IN ONDO STATE? MAY THE SPIRIT OF THE LORD JEHOVA GUIDE AND CONTROL THE JUDICIARY AT THIS CRUCIAL STAGE OF THE PETITION. MIMIKO’S STOLEN MANDATE MUST BE RETURNED. HAPPY SUNDAY

By the grace of the Lord Jehovah, the much awaited Ondo ~State judgement shall soon be delivered and in favour of the correct winner of the April Polls i.e. Dr Rahman Olusegun Mimiko in Jesus name. I take refuge in the words of the Lord daily and in the power of prayer. God is not a man that he should lie. He has said that he will never see the Righteous Forsaken and I know my Lord Jehovah will guide the Ondo State hearing to the very end.
Psalm 5: 4-6 – “For Thou art not a God that hath pleasure in wickedness; neither shall evil dwell with Thee. The foolish shall not stand in Thy sight; Thou hatest all workers of iniquity. Thou shalt destroy them that speak lies; the LORD will abhor the bloody and deceitful man”.
Psalm 7:8 – “The LORD shall judge the people: Judge me, O LORD, according to my righteousness and according to mine integrity that is in me”.
Psalm 1:6 – “For the LORD knoweth the way of the righteous, but the way of the ungodly shall perish”.
So arise oh Lord and may all our enemies, your enemies be scattered. MIMIKO IS THE MANDATE OWNER AND THE TRULY ELECTED GOVERNOR OF ONDO STATE. Even the extent of jubilations when all documents submitted were accepted by the tribunal shows that Ondo State has not stopped praying and supporting the man they cast their votes for in Ondo State en-masse, i.e. OUR MAN MIMIKO, IROKO SI LO MA JE BABA IGI.
I pray that victory will surely come to pass. There and then people of ondo state would sing a new song of joy.

Independent National Electoral Commission (INEC) in Oyo State, yesterday tendered two different results collated during the April 14 governorship election in the state, at the resumed hearing of the election petition filed by the All Nigeria Peoples Party (ANPP) gubernatorial candidate, Senator Abiola Ajimobi against the election of Governor Adebayo Alao-Akala.
The two different results have been admitted as exhibits by the tribunal sitting in Ibadan. The Head Operations Department of INEC in the state, Mr. Olubunmi Ariyo admitted that some results were either altered, re-written or cancelled, confessing that the results entered for Alao-Akala were altered on the results sheet.
Led in evidence by the counsel to the petitioner, Adeniyi Akintola, {SAN}, Ariyo presented the original result sheet where 4,400 votes recorded for the ANPP candidate on the CTC, changed to 440 on the original final result list at the Ibarapa East local government polling units.
The INEC official said, “My Lords, at the Local Government collation Centre in Ibarapa East, the total votes recorded for the ANPP Candidate was 4,400 while at the State collation centre 440 was recorded as the total votes scored by the same Candidate in Ibarapa East Local Government area as shown in form EC8D”.
The witness confirmed that in many units, no voter was accredited despite that votes were recorded and counted while in Ogbomoso South local government, only the PDP agent whose name was given as G.A Awujoola, signed as the party agent in two different wards while no party agent signed the result at all.
The INEC official told the tribunal that there was no accreditation in most of the units in both Ogbomoso South and Ogbomoso North Local Government areas during the election while in ward two unit one of Ogbomoso South, the total number of valid votes cast as recorded in form EC8A was 375 while in form EC8C where the commission had recorded 369 as the total valid cast in the same unit.The INEC official also admitted discrepancies in the recording of votes citing ward 8 unit 1 of the Ogbomoso North, where the number of votes cast on the CTC showed 245 while the original bore 568; unit 2 has 1,052 but 666 votes were recorded on the original; in unit 3, 307votes were recorded against 304votes on the original sheet.In another list presented at the tribunal, 390 was recorded on the CTC against 432 on the original list; 300 against 607; 324 against 328 for ward 8, while in ward 10, 200 recorded against 290 recorded on the original INEC list.In ward II units 1, 2 and 3 of Ogo Oluwa local government, none of the voters was accredited while all the figures as votes cast during the poll initially written were cancelled and not countersigned.In unit 3, the 200 votes which were initially recorded, according to the INEC witness had to be cancelled and changed to 468 votes.Pointing out other areas of non-comformity with the Electoral Act by the INEC officials, the INEC official confirmed that instead of blue ink officially recommended by the INEC for the accreditation of voters, in many lists, black and red inks were mostly used.
Tribunal Update.
Today, PDP continues their objection to presented documents and with this, the Tribunal decided to defer further hearings till 12/13/07 and instructed the PDP to write all their objections before that time(and probably will tackle the objections even before the date) so as to prevent further delay tactics ( I belief, this will forstall any further attempt by PDP to object daily to one document at a time).
It`s now obvious even to the skeptics that PDP in Ondo State has no case and the verdict is indeed very close.

AKURE—THE Independent Electoral Commission INEC yesterday stormed the Election Petition Tribunal in Akure, Ondo State with over 150 bags of used and un-used ballot papers and other documents as requested by the governorship candidate of the Labour Party in the April 14 governorship election in the state, Dr Olusegun Mimiko.
Dr Mimiko is challenging the victory of Governor Olusegun Agagu in the last elections in the state at the election petition tribunal sitting in Akure the Ondo State capital.
Counsel to the Labour party, Dr Olumide Ayeni had subpoenaed the Resident Electoral Commissioner REC in the state, Alhaji Abubarkar Ahmadu to present some electoral documents used for the polls in some contentious council areas of the state.
Appearing before the tribunal headed by Justice Garba Nabaruma, the commission’s Chief Logistic Officer, Mr Toyin Abegunde brought the documents in a pick up van belonging to the commission.
The documents are electoral materials used in Ilaje, Okitipupa, Irele, Ese Odo,Ile and Oluji/Okeigbo during the April polls
Would PDP if they were convinced they won the April Polls not want to quickly have the hearing and verdict in this petition? Why are they playing games and trying to disrupt/push forward the petition results? Because they know that they were losers and will lose once again. It is indeed very sad and disturbing that justice and truth are being tampered with and “nigbawo ni Maku o ni ku?”. Ondo State had better keep a tight reign on the activities of Agagu in Ondo State from now till when the petition result is out for he is not to be trusted. I have a feeling that by trying to buy time, he is up to nothing good. I heard rumours of PDP saying they have a game plan but paid no mind to this, for rumours are distracting. One thing is clear, God is in control and nobody can be above God or change His will.
I dare say that I do feel disappointed that PDP is allowed to pervert the cause of justice with antiques, but then this is the legal system for you. It doesnt matter how long now for all shall be well that ends well.

Congratulation Dr.Mimiko. The Lord has vindicated you and has given you back your stolen mandate. I pray that He will grant you the wisdom you need to govern the State and that you will not disappoint Ondo people.The past administration had already seen the handwrIting on the wall even before the verdit was given. That the end has come was obvious and some them will have to regret their roles in the last election as the were forced uot of their offices shamefully. Let all our leaders note that is a good thing to get into office of power and leave the same office with greater honour. This is my praer to you Dr. Mimiko. God bless you, God bless Ondo State.
