Mimiko-Phenomenon: The Power of Grassroots Politics
When Mimiko, a grassroots politician and the former Housing Minister under President Obasanjo, declared his intention to run for office early December last year, and after he moved from the deep-pocketed Nigerian ruling party (the PDP), and aligned with, and got adopted, by the Labor Party, a formerly obscure political party, a move one would have deemed suicidal; his stock sudden skyrocketed, and has been rising in a linear progression since then. This is an unprecedented occurrence in the political story of Ondo State and perhaps in Nigeria. Why so?

The Fear of Over-confidence
The mimiko-phenomenon…is real and I agree with the written 100%. However, I fear that those manning his campaign will not get drunk on the mass appeal and sudden goodwill Obasanjo’s statement and attitude have showered on them. Agagu has been tested on the campaign trail, not once but thrice – with Deputy to Olumilua SDP 1993, Governorship PDP 1999 and 2003. Mimiko has never being on the campaign trail in this manner.
While I don’t know the capability of those in charge and directing the campaign efforts, it appears his media has totally overlooked the relevance of the Internet and the Ondo state indigenes in the Diaspora.
The Internet as this Website is demonstrating (Thank You!) can be used to initiate rapport with those not on ground, though We in the Diaspora can’t vote, we have huge influence an dgoodwill amongst our people back home, we can influence and encourage people to vote Labour come April. We have resources and ideas; we all know money is crucial; but winning an election is not all about money.
We need to know what is going on on ground. It is strange that the official website (segunmimiko.com, I think) is so thread-bare content-wise: where are the photos and media on the campaign? Any Audio interviews?
Does Mimiko have a family????? Who is his wife, he has one for sure!
Who are the other Labour party candidates in Ondo state? Mimiko needs to have a strong base in the of state and national assemblies for him to be successful in office, right.
Mimiko has started on the very good note, his stock is already 100%, now its is up to those around him to ensure that the stock stays up, and one way to do this is to think out of the box, and be efficient and innovative on the ground; it’s the ‘little things’ that make a big difference at the end of the day.

It is an uncommon political antecedent in Nigeria for a member of a ruling party to decamp to the opposition and command such a great support as Mimiko has done. This will scare any incumbent, no wonder OBJ tries to pull a fast one, but that failed woefully, and worked to the detriment of the PDP not only in Ondo state but nationally. More importantly, this speaks volume to the nature of politician Mimiko is. It is accurate to state Mimiko’s the candidate to beat in Ondo state, and if he plays his card right he has already won!

I am an Evangelist of the Lord and also a woman, but when OBJ commandered our Mandate from Ondo to Abuja and forcefully declared a none entity that was not voted for – I mean Agagu as the winner of an election that MIMIKO had already clearly won in 14 out of 18 LGA’s, I saw red and for the first time really understood what drives some to become suicide bombers. Let us still thank God for his mercies. Our MANDATE IS ONLY BORROWED. Reading through the recent headlines on Obasanjo’s speeches. actions and advice to Nigeria, I could not but pity the man in spite of my real disgust at him and what he stood for in the recent past in Nigeria. He is showing signs of a man who is on the verge of a breakdown, haunted by the ghosts of his shameful past and afraid to leave and become a shadow which many will rather want to forget. He breaks down weeping – what for? He advices that God is the only power to reckon with – did he remember this when he was damaging and maiming people? He accuses other politicians of using JUJU Socery & occultism – which has he used and is he innocent of any of these? He delves into the past and brings up so called solutions to problems unsolved – why did he wait so many years to offer these solutions? and many many more…. IS OBJ LOSING IT? Whatever – Nigerians cant wait to see you leave and !!!!!!!! at your Otta farm
Now Wole Soyinka replies OBJ and calls him “BLASPHEMOUS & UNCHARITABLE,” further stating that OBJ is suffering from “withdrawal syndrome”. This is in response to OBJ recent ramblings or should I say confessions about his reign of death – including that of Bola Ige which he seemed to have forgotten and which many are keen to remind him of. I read with horror the recent unrest at Ibadan and i pray we do not allow this to happen in ondo State. The shedding and waste of human life is not the answer. Violence should be the very last resort if all fails and even then not indiscriminate violence and rampage. Jerry Rawlings type in Ghana is more effective if powers in high places do not allow for the truth and eradication of corruption in Nigeria. Let us all collectively and Individually encourage the people to eschew violence. I hope the Electoral Tribunal are following these developments and learning from them. The people say they cannot be fooled all the time. Please do the right thing. “IGE: HITTING A MAN WHILE HE’S DOWN AND FIGHTING THE DEAD

The saga of the current President of Nigeria, retired army General Olusegun Obasanjo will continue to confound people even after he is no longer in the public realm. Olusegun Obasanjo is a man who seems to be against all and his latest comments in the regard of the late Attorney General of Nigeria, the illustrious Bola Ige are not unusual but very unfortunate.
It is also a well known phrase that the evil that men do will be remembered after them. Perhaps this is what the President wanted to disprove by telling a wise nation at the twilight of his presidency that Ige was killed by some concocted drug barons. The President is an incredible story of discrepancies. He told the nation two weeks ago that he had some regrets over his failure over electricity and others but later ‘like a fallen masquerade pretending to be performing’ reversed to say he had no regrets! He went to sleep on Ige’s matter for more than seven years and suddenly awakened to the need to do a story before leaving Office in two weeks! He was in the thick of ‘wars’ in Anambra, Bayelsa, Ekiti and particularly Oyo but refused to commandeer his Police lapdogs or the Oyo PDP Government to find the killers of his friend and Attorney General after the Ladoja Government opted to close the case file.
Ige was slaughtered on December 23, 2001 in his bedroom at Bodija , Ibadan in Oyo State where he was a civilian governor from October 1979 till September 1983 and until his death was a deputy leader of the Afenifere – the foremost Pan-Yoruba group. Ige was undoubtedly a foremost Yoruba leader with very high visibility.
Bola Ige was invited to participate in the 1999 first term regime of Obasanjo and never mind the justifiability or otherwise in his agreeing to participate. His participation gave Obasanjo the leeway to stabilize his zero acceptance in the South Western part of Nigeria and he owes the Cicero a lot of thanks. Obasanjo is not considered by the Yoruba as one of the leaders up till today, if free and fair elections are allowed in Yoruba land, Obasanjo and any associate will lose woefully.
The participation of Ige in his government was not to the advantage of unity of purpose in the Yoruba land but he (Ige) was a revered leader and therefore his participation brought a lot of breathing space to Obasanjo.
Ige submitted a letter of resignation to Obasanjo on December 19, 2001 after heeding several letters and calls for him to quit so as to help consolidate the progressive base in Yoruba land. In fact, this writer like many others inundated the Cicero with appeals to quit the government and help to re-unite the Southwest.
Ige was assassinated on December 23, 2001. That was 5 days after submitting his letter of resignation. It is now about six years since Ige was gone but his killers are free in Nigeria and perhaps all over the world. The governments at both the Federal and State have chosen not to go after the killers while the Police had some months ago told a surprised Nigerian world that the murder case was closed. The speaker? the number one man in the Police who is also a lawyer!
The President in his characteristic display of unpresidential protocol some days ago took over the job of the Police which had told a helpless nation that the Ige murder was closed after it could not get any clues or way forward. Olusegun Obasanjo told the nation that Ige was murdered by a drug baron.
Remember the same President did the same when a zonal Chairman of his party – PDP , Dikibo was gunned down. He went to the Press barely 24 hours after the murder to say that the poor man was killed by armed robbers while his Police became dumbfounded because they were yet to commence investigations!
To all the followers of the Ige murder case, this ‘drug baron’ story from the out going President is a diversion because the son of Ige, Muyiwa saw the assassin with the gun on the day of killing and again during one of the Court hearings. The first child of Ige, Mrs. Adegbola dutifully countered the President to tell who the drug baron is, why it took him this long to say this and importantly to add that his father gave a letter of resignation to the President on the 19th December, 2001 and got killed on 23rd December, 2001. The poor daughter went further, to prove more points that the President was just being uncharitable to describe his father in low terms. The final note from her was that God would judge which to some people is a poor soul’s prayer.
To all people with human compassion and even the adversaries of Ige, the family of Ige needs some sympathy having lost their father to a brutal killing, their mother died after seeing the way the case was ‘somersaulted’ and a family friend – the brilliant Ibadan man of integrity, Akande out of frustration.
To all real respecters of God, do we need to be reminded that it is unAfrican to speak ill of the dead? Does it make sense to attack a dead man who is not a position to defend himself? Is it part of fair rule to hit a man on the floor?
Some actions make people to marvel at the incomprehensibility of the supreme being. His ways are never that of men indeed. The Psalmist too informed that the wicked do prosper sometime while the people wonder if God is watching but the same Psalmist reminded He is coming and very swiftly, to pay unto each and everyone according to his deeds.
The President really confirmed some speculations concerning Ige’s brief time in the Mines and Power where the Cicero had wanted to work with his greatest vigor. Obasanjo removed the chair from under Ige in the Mines & Power Ministry because the latter was going the popularity route by declaring that he would turn ‘stones to bread’ there. That must be to chagrin of a domineering person like Obasanjo who saw himself as the only one to get credits for all actions. Obasanjo publicly admonished Ige over his statement by saying he did not know what he meant by his promise and subsequently appointed someone else to supervise the power sector leaving Ige with apparently no control over the sector as the man in charge of power sector was to report directly to the only righteous OBJ. Ige should have quit then but he had a political point to score against his fellow Afenifere over the then fresh Alliance for Democracy presidential primary debacle. Who knows if he would be alive today with his wife if he had not gone to bed with Obasanjo’s government?
Why on earth would the President describe the Ige as someone who could not differentiate between his ‘right and left hands’ in the Mines and Power? After all, OBJ ridiculed the superior intelligence of Ige by making him useless over same Power sector. Is the President on the same pedestal level if placed against Ige – the lawyer who went to a formal University, an established master and an acknowledged man of letters?
This writer as a member Bola Ige Vanguards was unhappy when Ige agreed to serve in the 1999 Cabinet of Obasanjo and joined others to write him to quit. The President, like his friends, ex friends who had suffered in his hands and others know, enjoys dominating. Ask the former PDP Chairman from Kogi or the one from Plateau. This is why he finds it difficult to belong in the comity of people with superior intellect and education unless they allow him to dominate over them.
He had morbid hatred for Awolowo and had to write with derision in his book against the acknowledged sage even after his death. He had only negative comments for Abiola when he was in jail and in the grave!
He knew why his book making jest of Awolowo would be good only for himself and cronies if it was published while the greatest leader since 1959 was alive and only published after his death.
In the same vein, he knew that the Ige who was more accepted by the Yoruba and still in death, would not allow him to get away with such words as “not knowing the difference between his right or left hands”, he acted the coward that he truly is, by waiting till his death.
Is the President a better man in intellect, education, politics and most human endeavors than Ige?
The President has an unenviable history of betraying his friends or cutting of the hands of people who have helped him with their hands. Ask the family of Kaduna Nzeogwu despite the pretense on display, the family of Ige, Theophillus Danjuma who vowed to go on exile if his friend did not win in 1999 and many others who are yet to recover from the real Obasanjo they did not know.
The full truth about men and women who connived to kill Bola Ige, Dokibo, Funso Williams, Harry Marshall and many others between 1999 and 2007 will be unraveled after Obasanjo and if not immediately but definitely before long. It took the aftermath of Abubakar Abdulsalam before we know who were Sergeant Rogers, Mustapha, Bamaiyi and Company. The popular Yoruba adage says it all: that it takes a single day for truth to catch up with all the evil doers and their lies even though they might hide for years.
The harm by regimes will always be corrected by the succeeding regime while it is unfortunate that the evil people do see themselves as the good people when people of conscience do not speak up. If bad people are not identified and told of who they are, they tend to see themselves as good people in the nation.
The same goes for all these hungry men and women who parade some suspicious higher degrees because their letters and words on the internet belittle the attached degrees and do not conform to the real deals. There are hordes of Nigerians who live abroad but who are not disentangled from the impoverishing tactics of Nigerian leaders at home. These hordes are found on the internet and other media using the sponsored internet spaces to virtually look for favors from many State Governments in Nigeria and also from the Federal Government. By their seeds, they shall be known. These men are only doing the bidding of their pay masters in Nigeria and do not want to stand on the side of the people, hence avoiding issues of popular interest to the Nigerian nation. These are the people who run around the corridors of power asking for contracts or appointments to the detriment of the people because they sell their souls to the dogs.
Nigerians should look for food to eat but not through bloody means and those abroad should watch for some of these suspicious higher degree holders who think they could use any one to sell their dirty wares at home.
In the matter of 2007 elections, most Nigerians and all well wishers of the truth are in one agreement that Obasanjo organized the worst, most fraudulent one in the history of Africa and particularly in Nigeria. The lapdogs of history do not want to annoy their paymasters and have been trying to rubbish the truth by alluding that the elections were otherwise. The International monitors including the Obasanjo government sponsored people found nothing good to write home about in the April elections in Nigeria while a former Secretary of State from United States had to say this openly obviously with disgust. Yet some internet men working for some interests other than that of Nigeria or Nigerians have been trying to ‘color’ the darkness of April 14 and 21 in white.
Posterity will definitely have no sympathy for men who refuse to stand for the truth because of food while those who choose to remain silent in the face of tyranny or fraud will have their conscience to worry about for as long as they live.
Whoever kills will also have death as a sentinel at the door of his life no matter how long he or she lives.”

There is palpable fear in the inner camp of President Olusegun Obasanjo as president-elect, Alhaji Umaru Yar’Adua, increasingly asserts himself over certain issues and key appointments, including his believed refusal to accept Gen. David Mark as the next Senate President…
However, the most discomforting for the president appears to be what is now seen as the increased effort on the part of the incoming president to not only court and fraternise with former Military President, General Ibrahim Babangida, but also sound out the retired General on key decisions and major policy directions.
The incoming president is believed to have visited the Minna residence of the Babangidas at least once since his election and continues to have unrestrained telephone conversations with the former head of state.
Indications that the president was beginning to question his choice of Yar’Adua as successor emerged, last Friday at the PDP retreat where Obasanjo alluded to the fact that it was virtually impossible to deconstruct Yar’Adua and find out what is on his mind.
He said the president-elect was more of a listener than a talker and could not be dragged into conversation or discussing any issue. He said that unlike him who was always quick to react, Yar’Adua was more calculating…
According to the source, Obasanjo is increasingly becoming convinced that rather than he, IBB might emerge the godfather of the incoming administration. Although the prospect had initially sent cold shivers than the president’s spine, he is said to have consoled himself with the conviction that he was sure Ibrahim (IBB) would not want to send him (OBJ) to jail.
However, the president is said to be fearing for his legacy and what would become the fate of the new club of billionaires his regime has created, given the unhidden determination of the clique now massing around Yar’Adua to revisit the ongoing privatisation exercise as well as the questionable sale of public property to a select few.
Although Yar’Adua has pledged to continue with the reform programme of the Obasanjo administration, he is believed to have resolved to have a second look at some of the details, particularly the privatisation exercise. He is also determined not to inherit certain persons from the Obasanjo years whom he considers to be more of liability than assets. Among these is a former military administrator who the president had, at various times, allegedly nominated for Minister of Works and Chief of Staff.
Yar’Adua had also expressed unwillingness to work with certain chieftains of the party and members of the present federal executive council whom Obasanjo had asked him to try and accommodate in whatever capacity possible. This is even as the new president has continued to surround himself with only his own trusted lieutenants.
Meanwhile, Obasanjo’s determination to impose Senator David Mark on the in-coming National Assembly as Senate President may also lead to a major face-off between the outgoing president and the president-elect.
Saturday Sun gathered in Abuja, at the weekend, that while Obasanjo is hell bent on imposing his fellow retired military officer on the upper chamber, Yar’Adua wants the matter to be left to the lawmakers to decide, a mild way of saying he is not comfortable with Mark.
Impeccable sources at the International Conference Centre, Abuja, venue of the just concluded special retreat for those who have been elected on the party’s platform confided that the choice of the next president of Senate may be the first acid test for the incoming administration…
“It is unfortunate that the South West might have lost out as a result of alteration of the original zoning formula adopted by the party… For political expediency, it would not be advisable to have another politically powerful national figure who may be a major threat to Baba’s (Obasanjo) pre-eminence in the party’s structure,” the source confided.
According to the source, the decision of the out-going president to anoint Mark was informed by the need to have a trusted person, especially, of military background to checkmate Yar’Adua in events he may want to be unduly assertive.
“Let me tell you, people are beginning to be afraid of Yar’Adua. Not even Baba is comfortable with the man. Here is a man you can’t deduce when he is angry from when he is happy… The choice of Mark by the President is to provide an effective check on the presidency. It is the view of the president that it is only a strong personality like Mark who has a military background that could effectively check the in-coming presidency.
Investigation at the PDP retreat however revealed that it would not be smooth sailing for Mark as some of the new Senators are determined to ease him out if he is eventually imposed on them.

Agagu Sworn in Amidst Tight Security

Amidst tight security provided by the men of the Nigeria Police Force, the State Security Services (SSS) and the Nigeria Security and Civil Defence, Dr Olusegun Agagu, was yesterday sworn in as the governor of Ondo State for another term of four years.
To avoid any unforeseen incidents and in compliance with the order of the Inspector General of Police, Sunday Ehindero, which placed all commands on red alert, vehicular movement into the celebration arena were restricted while people were screened by security men. The State Chief Judge, Justice Gladys Olateru-Olagbegi, administered the oath during a ceremony that took place at the Ondo State Sport Complex, Akure and attended by a crowd of party members and supporters, traditional rulers and supporters from the 18 local government areas of the state.
Agagu in the inaugural address catalogued the state of things before he took over in 2003 and various positive changes that had taken place in his first four years tenure promising that his administration would continue the good works of improving the lives of the people of the Sunshine State.
“Our key mission in the next four years is to work hard to expand the economic base of our state and move away from a system dominated by monthly salaries of teachers and civil servants.
“Industrialisation and commercialisation will open up new opportunities for job and wealth creation. I am glad that we have laid the foundation for rapid industrial development of our state and we are confident that the results would soon begin to emerge all over the state”, he said.
The governor said the administration would continue to pursue with vigour its activities in the social sector promising to build more model school buildings and employ more teachers.
He also promised that the state’s rural water programme will continue so that more people can have access to clean water while the health facilities will continue to be improved upon.
THE QUESTION THAT LURKS IN YOUR MIND AND MINE NOW IS THIS: DOES IT MEAN THAT ASKING THE AGGRIEVED PEOPLE WHOSE MANDATE WERE STOLEN TO SEEK REDRESS VIA THE ELECTORAL TRIBUNAL JUST A SHAM? Agagu is not the Governor of Ondo State – NO NEVER. He may have been sworn in on 29th May but as God is not in support of evil doers, so shall God visit Agagu with what he really deserves. Your Excellency Dr MIMIKO, this struggle cannot be left in the hands of the Courts alone if justice is to be done. I beleive the people of Ondo State at home and abroad who want the truth to be declared should now sign a petition to be presented to Yaradua. We should start a link be e-mail and also be hard copy and have signatures from all over the world requesting that the Electoral Tribunal must conclude this case and if found guilty (which we all know he will be) Agagu should be disrobed and sent packing in disgrace.

NO 60-year-old person will ever rule this country again. The political party we belong to, the Peoples Democratic Party has used its platform to deliver Alhaji Umaru Musa Yar’Adua, a man who is slightly above 60, and Dr. Goodluck Jonathan, who is slightly under 50 years, as president-elect and vice president-elect of the Federal Republic of Nigeria. The duo of Yar’Adua and Jonathan is the youngest to emerge democratically as our leaders. – Former President Olusegun Obasanjo at last week’s valedictory session in his honour.
IT is possible former President Olusegun Obasanjo still thinks the PDP and himself will continue to decide the future of Nigeria in the same undemocratic manners they attempted to do over the years. Otherwise, it is difficult to see the value of his latest contribution to the well being of the Nigerian state.
The constitutional requirement on age for the offices of president and vice president is 40 years. There is no upper age limit. Obasanjo, who became president at 62 wants to dictate the age of future presidents, a purely constitutional matter. Is this about his unfinished battles with those he does not want to be president, ever?
We are however more concerned about the fallacies in this position. There is no evidence that the problem with Nigerian leadership is the age of the president.
Evidence, however, abounds that vision, lack of it, is a major problem. Nigerians should decide who they want as president, within the provisions of the Constitution, and change those provisions, if they wish, through constitutional means.
Obasanjo does not appear to be in touch with Nigerian history, nor with those he worked assiduously to succeed him. If he wants to create the impression that Yar’Adua and Jonathan are the youngest people to occupy that office, he is absolutely wrong.
At 62 when he assumed office in 1999, Obasanjo is Nigeria’s oldest elected president. Yar’Adua is not “slightly above 60”. He was born in 1951 – 56 years ago. Nor is Jonathan “slightly under 50 years”, the Vice President was born in 1957, he is 50 years old, and celebrated it with relish earlier this year.
In case the entry of these “young people” is an achievement, Obasanjo should note that former President Shehu Aliyu Usman Shagari, who he handed over to in 1979, was 54 then. The Vice President Alexander Ifeanyichukwu Ekwueme was 47. Was Shagari undemocratically elected in the election Obasanjo supervised in 1979? Former Prime Minister Sir Tafawa Balewa remains the youngest democratically elected person to rule Nigeria. Born in 1912, he assumed office at 48.
There are grave dangers in deliberately crafting errors into our history.
Nigerians want good leaders, no matter their age, unless Obasanjo is admitting that his age affected his performance, adversely. Even if it is so, Obasanjo should make a more open confession instead of befuddling issues with his panacea.

We shall continue in our daily prayers for our man MIMIKO THE TRULY DEMOCRATICALLY ELECTED GOVERNOR OF ONDO STATE UNTIL HE IS GIVEN BACK HIS STOLEN MANDATE. Agagu may have been sworn in but he is not the elected governor of Ondo State. The just shall live by faith. Mimiko will win the petition for what he is doing is on behalf of the masses in Ondo state and not just for a selected few. No one should be fooled that Agagu will change overnight for a leopard will and can never wash off its spots. Given a few months (if allowed), he will, when the euphoria is over go continue with his old ways of embezzling, enriching personal pockets and fooling the people of Ondo state. He does not love the people. He knows at the back of his mind that over 80% did not vote for him and he knows he will never ever govern or rule again in Ondo state so if you think Agagu will do anything good for Ondo State – spare me, please think again. Hold Ondo Govt Responsible For Awanebi’s Murder, Says LP

Ondo State chapter of the Labour Party (LP) at the weekend asked the state Command of the Nigeria Police Force to hold the Governor Olusegun Agagu-led government responsible for the murder of former Chief Security Officer (CSO) to the governor, Tunde Awanebi.
It said by Awanebi’s murder, the party had been robbed of a key witness in the electoral fraud hanging on the neck of the Peoples Democratic Party (PDP) at the Election Petition Tribunal.
In its reaction to interviews granted to the press on Awanebi, last Friday in which he accused LP of complicity in the murder, the party insisted that since Femi Agagu had taken it upon himself to act as the prosecutor, as well as the spokesman for the police by asking them to arrest members of the party whom he alleged had a hand in Awanebi’s killing, he should be invited by the police to substantiate his claims.
LP Director of Press, Kolawole Olabisi, whom the younger Agagu asked the police to quiz, in an interview with newsmen on Sunday dared the younger Agagu to come out with facts and evidences to deny that the late Awanebi was killed barely seven hours after he was replaced by the government with the Principal Security Officer (PSO) to Agagu as was reported by most of the dailies the following day he (Awanebi) was killed.

AC Condemns Assassinations, Kidnapping In Ondo, Osun

The Action Congress (AC) has condemned the spate of assassinations in Ondo State as well as the abduction of a legislator-elect in Osun State, describing the developments as dangerous fallouts of the violence and manipulation of the last general elections.
In a statement in Abuja on Sunday by its National Publicity Secretary, Lai Mohammed, the party noted that the assassinations and the kidnapping occurred in the two states where votes were believed to have been manipulated by the Peoples Democratic Party (PDP).
AC said it was particularly shocked by the two successive assassinations in Ondo State, and then wondered on what could have justified the killing of human beings.
The party called on the police to urgently unravel the killings as part of efforts to stem such dastardly acts, protect the people from the atmosphere of fear triggered by the murders as well as to stop the finger-pointing by two of the parties in the state.
“We do not know what led to the killings or those behind them, but we do know that those who have engaged in evil acts, such as election manipulation, will stop at nothing to cover up their tracks,” AC said.
On the abduction of an AC legislator, Timothy Owoeye, from his home in Ilesa by unidentified men, the party said it was probably part of an organized plot to harass and intimidate AC lawmakers in the state.
“Perhaps, the plan is also aimed at depleting the number of AC legislators in the state House of Assembly, after the powers that be had failed in their attempt to rig them out,” the statement said.

Real Killers Of Ige Will Soon Be Known, Says Son

Muyiwa, son of slain former Justice Minister, Bola Ige, has condemned former Inspector General of Police (IG), Sunday Ehindero, for his attempts “to distract attention” from those who committed the crime.
“The real killers of my father would soon be known”, he stated at the weekend at the 13th Founder’s Day of The Vale College, Ibadan, a private secondary school owned by his sister, Funso Adegbola.
Adegbola said the Founder’s Day was set aside to remember another deceased member of the Ige family, Babatunde, who was born on June 2, 1962.
Muyiwa disclosed that there was an item stolen from his father by his assassins, which will soon lead to their identification.
He maintained that the family does not believe that four suspects recently paraded by Ehindero were the culprits.
He recounted events that occurred near the end of the administration of former President Olusegun Obasanjo concerning his father’s death as drama intended to divert attention from the real perpetrators of the act.
“It is so sad and unfortunate that the government has continued to play games with the investigation of the murderers of my dad. It is because they are not intelligent enough that they think they can fool all of us”, Muyiwa lamented.
“The blood of my late father will continue to hunt all of them. The truth of the matter is that when you take a human life, you can never have a settled mind again.
“They are just trying to divert our attention to another direction from the real reason he was killed and the real killers of my dad. But I believe strongly that at the end of the day, the truth will be known and the whole world will know the true killers.
“Three different Inspectors General of Police have handled the case, and none of them was able to tell Nigerians the true killers of the Attorney General of the country who was assassinated while still in office. It is a big shame.
“We have had (as IGs) Musiliu Smith, Tafa Balogun, and Sunday Ehindero. I think we have to leave the matter alone. It is like we are just giving credence to their nonsensical drama if we continue to debate the issue”.

Quick Disposal of Election Cases

WITHOUT prejudice to the provisions of Section 294 subsection (1) of the Constitution of the Federal Republic of Nigeria 1999, an election petition and an appeal arising therefrom under this Act shall be given accelerated hearing and shall have precedence over all other cases or matters before the tribunals or court”. – Section 48 Electoral Act 2006.
This vacuous provision of Electoral Act 2006 is one of the battles before aggrieved candidates in last April’s elections. The law does not recognise the imperative of urgency in their search for justice.
Candidates in the 1999 and 2003 election, who believed they were rigged out, also faced similar problems of delayed or prolonged hearing at the election tribunals , the main issue is that neither the Constitution nor Electoral laws specifies the time frame within which election petitions should be concluded.
The equitable maxim; “Justice delayed is Justice denied” aptly summarises the plight of election petitioners in tribunals across the country. Nothing so far seems available to address this lacuna. The Electoral Act 2006 looks so vague in its provision calling for accelerated hearing. Election petitions are heard in speciailsed tribunal established and empaneled for that purpose so the need for giving election matters precedence over all other cases does not arise for apart from election petitions, no other matters can be brought before the tribunals.
Peter Obi, immediate past governor of Anambra State, only reclaimed his mandate over three years after he won the election. The delayed disposal of election matters has created the problem of tenure interpretation for elected officials. Some legislators also reclaimed their seats through the tribunals nearly two years after they were elected. Is this the new meaning of equity?
There are glaring defects in the electoral laws that need rectification through quick, but profound, electoral reforms. It may be necessary to include provisions for officials who did not win elections and are sworn in to refund their illegally earned wages and privileges. Moreover, if the issues are pursued conclusively, actions they took while in office should be illegal. The current practice of officials whose cases are before tribunals using states resources to meet their legal fees, should be abolished.
Each election since 1960 has been rated worse than the preceding one, the only exception possibly being the June 12 presidential election in 1993. The controversies that trailed the April elections left in its trail many aggrieved candidates. Some of them have approached the tribunals for justice. Another problem they may have is that INEC made such a mess of the elections that it may be extremely difficult to stick to the issues. Time is of essence and the Court of Appeal in realisation of this introduced new Election Tribunal rules to ensure quick disposal of cases. All material evidence, witness names supported by affidavits and everything necessary to prove a petitioner’s matter must be submitted with the petition.
Election Tribunal members should aid the cause of justice by over-ruling legal technicalities that might act as cog in the way of quick disposal of petitions.
Fair decisions in these matters would restore some confidence in the electoral system.

Indication that the ruling Peoples Democratic Party (PDP) may not have been through with the experience of former President Olusegun Obasnjo in solving major political problems emerged yesterday when Chief Obasanjo prayed that the leadership would not have to summon him.
Chief Obasanjo, while speaking at the ceremony to herald his home coming organised by the Owu community after eight meritorious years of serving Nigeria, said that he hoped the party would allow him to rest at least in the next one month.
At the occasion, the memories of the Sage, Chief Obafemi Awolowo and Late Chief Moshood Kashimawo Olawale Abiola were rekindled as the host governor Gbenga Daniel went down memory lane.
“When I was leaving Abuja I said to the chairman of PDP who has the burden of our party , I said as far as our party is concerned we can say it is signed, sealed and delivered, and he (the chairman) nodded his head in agreement.
“I said my prayer that God will be with you as you struggle with the work of the party in Abuja. You can always count on my support but I do hope that you will not have to summon me to Abuja in the next one month,” Chief Obasanjo said.
Reacting to the encomium showered on him over the success recorded by his administration in the last eight years, Chief Obasanjo noted by saying, “let me say this, what makes the difference between success and failure is very small. Success requires a little bit of effort, a little bit of courage, a little bit of fitness, a little bit of vision and a little sense of commitment.
Speaking on the occasion which was attended by all the South West governors, Gombe and Akwa Ibom State governors, the host governor, Otunba Gbenga Daniel paid a glowing tribute to the former president and elder statesman.
He said Ogun State was proud of Chief Olusegun Obasanjo and his achievements in all walks of life, noting that the state was lucky to have produced virtually all the presidents of the country to have come from the South West region.
“The state has produced virtually all the heads of state and presidents from the South West: the best president Nigeria never had, (Chief Obafemi Awolowo), the one that won election but never sworn in, (Chief MKO Abiola), the one that we are told was allowed to sit at the edge of the chair and the greatest of them all, the one that relunctantly had to be head of state in 1976.
“The one that voluntarily handed over power in 1979 and when he was handing over there was no nepotism, he gave power back to the other side of the country. The one that came back from the prison and became president,” Daniel said.

‘Seek reconciliation with those you antagonised’

The Primate of the Church of Nigeria (Anglican Communion), Rev. Peter Akinola, on Sunday said that the time had come for former President Olusegun Obasanjo to seek genuine reconciliation with God and those he deliberately antagonised.
Akinola gave the advice at a thanksgiving service in which Obasanjo acknowledged that his kinsman, Basorun M.K.O. Abiola, won the June 12, 1993 presidential election.
At the service organised for the former President by the Egba Traditional Council at the Cathedral of Saint Peter, Ake, Abeokuta, Akinola said that Obasanjo had reached a stage where he must chart a new course in life.
He said, “Thank God, you are already 70. The biblical three scores and ten. By the grace of God, the house in which you will live in is not your problem. God has given you far too many houses. What to eat is not your problem. Paying children‘s school fees is no longer your problem. So, what is your problem?
“You must dedicate the rest of your life to the service of God and the humble service of your poor neighbours.
“Two, you must seek reconciliation with people you deliberately and inadvertently antagonised.”
The primate also urged Obasanjo not to be preoccupied with materialism and mundane things.
He said “What is left for you is to be humble and shed off every of that excess luggage – those side attractions – every political expediency; all those military adventurism; all those unholy financial pursuits must go. They must go.”
Noting that God had been good to Obasanjo, the cleric added that he (Obasanjo) had recorded “huge successes in life.”
Akinola said Obasanjo had seen the best and the worst of times.
He recalled that Obasanjo had led the country three times (1976, 1999, and 2003) during which he had to contend with many difficulties.
Looking directly at Obasanjo, he said, “You had to take tough decisions and decisions that were misunderstood and mostly unpopular.
“But as a leader with a mission and with a clear mission, you believed in your heart that those decisions were the best for the country. You have been a dogged fighter.
“You have stepped on many toes, many big toes in our country. You have created enemies for yourself within and without.”
The cleric also advised Obasanjo to reflect on his life and be concerned about how to make heaven.
“You have got the best in the world and your eyes have seen the worst in the world. All that is left now is to make heaven,” Akinola added.
Obasanjo, in his speech, said he would always be grateful to God and those who made his administration successful.
He said that if the Presidency had been a football trophy, Ogun State would have had it for keeps.
He said, “I have been telling my friends in Abuja that if not for bad belle, Ogun State would have had Presidency permanently zoned to it.
“This is because if Abiola had been sworn in for the election he won; Chief Sonekan had the privilege of the stint he had; and me, of course, it would have been three times.”
He urged Nigerians to ceaselessly pray for the country and its leaders.
There was a stir during the service when the Lagos State Governor, Mr. Raji Fashola, joined the congregation. The governor was applauded several times.
The Bishop of Egba Diocese, Rev. Matthew Owadayo, who introduced Fashola and other dignitaries, was surprised by the applause.
He said, “Even as a minister of God, I am not only embarrassed but also scared.”
Dignitaries at the service included the Ogun State Governor, Otunba Gbenga Daniel; his wife, Olufunke; the Osun State Governor, Prince Olagunsoye Oyinlola; his wife, Omolola; the Alake of Egbaland, Oba Adedotun Gbadebo; the Agura of Gbagura, Oba Halidu Laloko; the Osile of Oke-Ona Egba, Oba Adedapo Tejuoso; and the Olowu of Owu, Oba Olusanya Dosunmu.
Others were the Ooni of Ife, Oba Okunade Sijuade; the Managing Director of the Nigerian National Petroleum Corporation, Mr. Funsho Kupolokun; and the Managing Director of the Niger Delta Development Commission, Mr. Timi Alaibe.

The case of delayed justice witnessed in the Peter Obi versus Chris Ngige petition at the Election Tribunal is an example that is still very fresh in the minds of Nigerians, Davidson Iriekpen writes that there is need for Election Tribunals in the country to expedite action on the various petitions before them instead of being bogged down by legal technicalities and the Independent National Electoral Commission (INEC)
That Nigeria strives for development is not in doubt. In most developed countries which Nigeria tries to emulate, electoral processes are pivotal and fundamental to democracy and development. Elections constitute a key part of the democratic process, which must be transparently conducted if it is to be considered credible. But unfortunately, each time we conduct an election, we usually falter in our bid to hold it creditably. Of all the elections held in this country, only that of June 12, 1993 was adjudged the freest and fairest. Every other elections have been characterised by complaints and protests of massive rigging and fraud. The 2007 election was no exception.
Pieces of evidence gathered by local and international observers that monitored the elections show that the elections ranked among the worst ever conducted in Nigeria. According to them, while voting did not take place in most parts of the country at all, there were instances of ballot snatching and ballot stuffing, as well as filling of result sheets at gun-point. This was the norm in most areas where the Independent National Electoral Commission (INEC) officials claimed elections held.
Apart from the above complaints, the different processes leading to and after the elections were not transparent. This was the view of most observers who participated in the elections. Listen to Mr. Pierre-Richard Prosper of the Washington-based International Republican Institute: “the system failed the Nigerian people and suffers a lack of credibility. The system, as designed, did not work. The elections fall below previous Nigerian elections and international standards”.
Following the conclusion of the election, hope had risen among Nigerians with the inauguration of election tribunals because lately, the judiciary has been delivering progressive judgments. Therefore, it is understandable that increasing attention is being paid by many people to the judiciary, especially the election tribunals, to help redeem the electoral process. Most people are of the view that the tribunals should conclude various cases in record time so that delay of justice at the tribunals as in the case of former governor of Anambra State, Peter Obi, does not re-occur.
It was to accelerate hearing of petitions, that the president of the Court of Appeal and chairman, Body of Benchers, Justice Umar Abdullahi, in pursuant to section 285(3) of the 1999 Constitution and paragraph 50 of the first schedule to the Electoral Act 2006, issued the tribunal and court practice direction, which main feature is the front-loading system that makes it mandatory that all petitions for the tribunal shall be presented within a specific time and must be accompanied by a list of all witnesses the petitioner intends to call to prove his case.
Those closely watching activities at the tribunals are worried that nearly three months after the general elections, the Election Petition Tribunals, to which the then President Olusegun Obasanjo advised aggrieved candidates to take their cases, are yet to resolve disturbing determine a single matter. Instead, reports from the tribunals indicate that games are being made out of the them to waste time. Defendants and respondents are evading summons by tribunal bailiffs. Petitioners are now going back to the tribunals to get order for substituted service.
Although INEC chairman, Prof. Maurice Iwu scored his commission 80 per cent in the conduct of the general elections, and promised that the commission would avail aggrieved parties at the Election Petition Tribunal any document needed to prove their case, the extent to which this promise has been kept remains questionable. In spite of all these, most Nigerians are worried that the tribunals have not determined any of the petition filed before them in most of the 36 states of the federation, considering the avalanche of rigging allegations from opposition parties particularly.
There are some things basically hindering the progress of the tribunals. It is either the Independent National Electoral Commission (INEC) in some states is not co-operating with the tribunals or counsel to applicants and defendants are frustrating the panels. A case in point is Rivers State where last week, Mr. Tonye Princewill, the Action Congress (AC) governorship candidate, accused INEC of disallowing him from inspecting critical materials to prove that the April election was rigged, adding that their conduct contradicts the recent directive of the commission’s National Chairman, Prof. Maurice Iwu.
The AC spokesperson, Eze. C. Eze, in statement, said contrary to the ruling of the election petitions tribunal, Princewill was yet to access the electoral materials he needed to prove his case. According to him, the party’s legal team, AC National and state officials were at the INEC’s premises for the inspection on June 28, 2007 at the time agreed by INEC, only to be told by the commission’s Administrative Secretary to come back the next day by 9a.m so that the whole day would be used for the exercise, explaining that when the AC team returned the next day, they were informed that apart from the ballot papers, all the other materials were not in the state and could not be inspected until those documents were returned to them from Abuja.
Eze said, “one wonders what documents that were used for state gubernatorial election should be doing at Abuja, if it is true, if not to alter and doctor them to justify the awesome illegalities that took place in the state as an election. We will like to call on Prof. Maurice Iwu to call on his people in Rivers State to order and direct them to allow us inspect these documents as directed by the tribunal and expose to the public that what took place in Rivers State was never an election but a fraud of the worst kind which will never go unexposed.”
The same was the case in Edo, Ondo, Ogun and Kogi states where Adams Oshiomhole of the AC, Segun Mimiko of the Labour Party, Ibikunle Amosun of the All Nigeria Peoples Party (ANPP) and Alhaji Abubakar Audu of the ANPP respectively were denied inspection of the materials in INEC custody
In Kogi State for instance, the Chairman of the Governorship and Houses Assembly Elections Tribunal for Kogi State, Justice Ibrahim Bako penultimate week, had cause to lambast INEC for delaying proceedings in the on-going suit between Prince Audu Abubakar and the commission who is contesting his unlawful exclusion from the Kogi State governorship elections.
Prince Abubakar Audu filed a suit before the tribunal to contest the unlawful exclusion of his name from the last governorship election, after being validly nominated by his party, the All Nigerians Peoples Party (ANPP).
Justice Bako during the preliminary sitting in Lokoja, expressed dissatisfaction with the delay of proceedings by INEC counsel, Chris Uche who has not filed any brief since the inauguration of the tribunal. “INEC is technically delaying hearings in this proceedings. INEC has not made any attempt to file any preliminary objection to contest the suit against them, since the inauguration of this honourable tribunal,” he said.
Justice Bako who also stated that the tribunal is under oath to stand by the laws said he would not sit and watch the tribunal being dragged into any controversy, adding that INEC’s counsel, Uche should do the right under the law by filing for a preliminary objection for hearing to start. He then advised both consuls to stop their clients from making any comments that might be prejudicial to the determination of the petitions.
In Abia State, the slow pace of the petition tribunal has sent tongues wagging among petitioners who have complied with requirements for the hearing of their petitions. As at Wednesday, the tribunal, which was inaugurated on May 21, 2007, was yet to commence hearing, more than five weeks after it officially inaugurated.
THISDAY gathered that the petitioners, notably Chief Ikechi Emenike of the All Nigeria Peoples Party (ANPP) and Chief Onyema Ugochukwu of the Peoples Democratic Party (PDP), have all filed their replies to the response of Chief Theodore Orji, whose electoral victory and subsequent ascendancy to the post of state governor is being challenged at the tribunal. The petitioners had filed their replies over two weeks ago, and have been waiting patiently for the tribunal to invite them for the conference hearing as planned.
“Our clients (petitioners) and all concerned Abians are worried that nothing is happening now in respect of the petitions before the tribunal, even when all necessary ground work have been completed weeks ago,” a lawyer representing a petitioner at the tribunal said, adding “in legal parlance, we say justice delayed is justice denied and we don’t want that to happen here.” He added that the expectation of every body was that the tribunal would dispose of the matters pending before it in record time without causing any anxiety over delays as is being witnessed now.
Election Petition Tribunals did not emanate from the blue. Section 140 of the Electoral Act 2006 provides for their setting up to adjudicate on petitions arising from returns of the elections. They argue that since the Electoral Act itself has provided for accelerated hearing of petitions brought before the tribunals, the different tribunals had better get cracking in order to reduce the uncertainties still pervading the political atmosphere in some states of the federation.
Section 148 of the Act stipulates that: “Without prejudice to the provisions of section 294 (1) of the constitution of the Federal Republic of Nigeria 1999, an election petition and an appeal arising therefrom under this Act shall be given accelerated hearing and shall have precedence over all other cases or matters before the tribunal or court”.
Perhaps, it is the importance attached to the exercise that made the Chief Justice to caution judges against compromising themselves such that their legal eyes would be blurred by bribe, even as he reminded them that the National Judicial Council (NJC) will not hesitate to impose sanctions on any erring judge.
While most analysts agree that the Nigerian judiciary has been up and doing in recent times, the question is: Would it rise to the challenge in face of the complaints that characterised the April general elections to salvage the system once again? Peoples’ hopes have been transferred to its domain on account of the diverse landmark judgments before the elections. According to them Dr. Segun Mimiko, governorship candidate of the Labour Party (LP), in Ondo State; Alhaji Rauf Aregbesola, gubernatorial candidate of the Action Congress (AC) in Osun State, Kayode Fayemi, governorship candidate of the AC in Ekiti State, Adams Oshiomhole, AC governorship candidate in Edo State, Ibikunle Amosun, governorship candidate of the All Nigeria Peoples Party (ANPP), in Ogun State; all have a good case before the tribunals.
By the practice directions issued by Justice Umaru Abdullahi, witnesses will front-load their evidence by writing down their testimonies and later enter the witness box to adopt the same statements on oath. Paragraph 4 sub paragraph 3 states: “There shall be no oral examination of a witness during his evidence-in-chief except to lead the witness to adopt his written deposition and tender in evidence all disputed documents or other exhibits referred to in the disposition.
Section 285 (3) of the 1999 Constitution and paragraph 50 of the 1st Schedule to the Electoral Act 2006 empower the President of the Court of Appeal to set up electoral tribunals and issue the practice directions for the tribunals to follow. The directions also empowered tribunals to dismiss a petition if the petitioner or his legal representative fails to attend a pre-hearing session or obey a pre-hearing order or shows unpreparedness to participate in the session or fails to participate in good faith. To persuade the tribunal to set aside such judgment, the petitioner will have to cough out not less than N20,000 and must apply to the tribunal to set such judgment aside within seven days.
A respondent, will have case decided against him if he or his legal representative fails to attend a pre-hearing session. Judgment will simply be given against him and he will have to pay not less than N20,000 to get another opportunity to participate in the hearing of the suit.
The directions urged lawyers, petitioners and respondents to cooperate with the tribunal to ensure speedy determination of petitions. The tribunals have also been empowered to go ahead and determine a petition even if it is only one party that is present. Where both the petitioner and the respondent are absent in court, the tribunals are empowered to throw out the petition.
But a public affairs commentator, Dayo Sobowale in his column criticised Justice Abdullahi for issuing the guidelines late. This, according to him, is what most of the tribunals would latch on for the delay. Hear him: “The elections were held three months ago, but the Court of Appeal is issuing its tribunal guidelines two weeks to hand-over. Why? The good thing would have been to get the guidelines ready even before the elections so that the lawyers for petitioners or aggrieved parties can seek redress immediately the election results were announced. The lateness of the all-important tribunal guidelines is an example of justice delayed, as most of those being petitioned against would have been sworn-in on May 29 and would have been vested, with legitimacy of office by the same judiciary probing how they got elected in the first instance. Surely this is a shoddy judicial arrangement or is it contrivance? One hopes it does not however lead to connivance at the end of the day. The judiciary has not been helpful in this regard”.
By virtue of Section 141 of the Electoral Act 2006, an election petition shall be presented within 30 days from the date the result of the election was declared. Any petition filed outside the statutory period is incompetent and liable to be struck out. And with respect to the hearing and determination of the petition, the law has merely provided for accelerated hearing to the extent that it shall take precedence over all other cases or matters pending in the court or tribunal.
In view of the failure of the judiciary to intervene decisively in the past on the side of justice and fair play in election petition matters, many aggrieved candidates have expressed lack of confidence in the election petition tribunals and the courts. It is particularly disturbing to note that not a few lawyers have advised Nigerians to look beyond the narrow ambit of the tribunals and the courts in addressing the highly flawed 2007 general election. But the question to ask now is: Are the present Election Petition Tribunals going to make these aggrieved candidates continue to harbour their reservations or change for good?
Rotimi Akeredolu, SAN spoke the minds of many Nigerian lawyers when he said: “The provisions of the Electoral Act did not contemplate the magnitude of the fraud which we witnessed in the so-called elections we just had. With the magnitude of the fraud and how to go about it, I am sure that petitioners must find it difficult, more so that this fraud was perpetrated with the connivance and the active participation of the Independent National Electoral Commission (INEC) itself We can give the tribunals a trial. I am not saying that nothing can happen there but I don’t have hope in them.”
In the same vein, Joseph Daudu, SAN has called on the Federal Government to set up a Judicial Commission of Inquiry to look into “the flaws that characterised the elections which led to the disenfranchisement of millions of Nigerians, identify the mode of rigging and those responsible as far as that can be determined for the flaws in the election and to recommend solutions for the conduct of future free and fair elections.”
The revered Chief Tony Enahoro on his part, advised Nigerians not to expect any miraculous developments in the tribunals and the courts that will handle the election petitions.
Based on his own experience, the septuagenarian stated that: “like gullible infants, the losers of the elections have been called upon by pacifists to go to the election tribunals. One may ask whether the judiciary should be over-burdened by electoral crimes deliberately committed by members of the executive and legislative arms of government, egged on by their patrons and godfathers. The judiciary is not a miracle worker. To ask the judiciary to resolve the kind of awesome and obscene violation of electoral processes blatantly displayed by political agents in the last general elections is like asking a physician to raise the dead from the grave.”
Other members of the public who are not so charitable with the judiciary have accused Nigerian judges of aiding and abetting election riggers due to the narrow interpretation of the provisions of electoral laws in a plethora of election petition cases.
In the case of Buhari V. Obasanjo (2005) 13 NWLR (PT 941) 1 the Supreme Court responded to the criticism when Belgore JSC (as he then was) said: “The petition perhaps holds record for its number of respondents, witnesses, exhibits and length of time taken to hear and determine it. I think this is due mainly to the Electoral Act, 2002 riddled with absurdities and anomalies, and several inconsistencies making it the clumsiest Electoral Act ever in the history of this country. But that was the only statute to work with, apart from aid from the Supreme law, the Constitution. The election tribunals were no doubt confronted with very difficult task; they had little room for abridging time or number of parties and witnesses.”
On his own, part Pats-Acholonu JSC (of blessed memory) bemoaned the state of the law and called for a constitutional amendment to empower the courts to deal with election petitions timeously. According to his Lordship: “We may have to evolve any methodology in framing future Electoral Acts to make trials very short, otherwise we risk having the present state of affairs coming up all the time. This would of course necessitate an amendment of the Constitution. A situation where an election petition lasted more than two years for a four-year presidential term leaves very much to be desired. It is an affront to the rule of law seen from an activist and progressive viewpoint or mind.”

Pursuant to the above observations, many civil society organisations made far-reaching proposals for the amendment of the law to ensure credible elections and speedy resolution of election disputes. But such concerns, however patriotic, were ignored by the National Assembly whose members were hoping to benefit from the status quo. Hence, apart from some insignificant amendments, the Electoral Act 2006 is in pari material with the obnoxious Electoral Act, 2002. Although the Judiciary has recently taken up the challenge of consolidating the fragile democratic process through adherence to the rule of law, it ought to be pointed out that the Electoral Act 2006 has been deliberately designed to subvert the democratic process.
From the antics of riggers, the judiciary should realise that politicians are taking the institution in vain. Perhaps, what the judiciary needs to do is to follow the example of the Supreme Court and not allow themselves to be used. One way it is effectively used is by lawyers, after being briefed to delay cases as long as possible, hiding under the cloak of technicalities to pummel justice. Recently, the former Chef Justice of the Federation, Justice Alfa Belgore advised against allowing technicalities to delay the delivery of justice. What he said was timely and should be considered as the summation of legal wisdom.
The attempt at reversing the results of the rigged elections is left to the election tribunals to determine, its members must be courageous, uncompromising, steadfast, realistic and above all, must have foresight. For the governorship legal battles at the tribunals, most people will be interested in the outcome in states like Ondo, Kogi, Edo, Ekiti, Oyo, Adamawa, Enugu, Imo, among others. Governorship candidates like Alhaji Bapatel in Adamawa, Dr. Segun Mimiko of Labour Party (LP) in Ondo, Alhaji Rauf Aregbesola of AC in Osun, Kayode Fayemi of the AC in Ekiti, Adams Oshiomhole of AC in Edo and Jimi Agbaje of DPA in Lagos have been very insistent on their success at the tribunals.

…As investigators unearth fresh shady deals in police

The noose appears to be tightening round the neck of the immediate past Inspector General of Police, Mr. Sunday Ehindero, as anti-fraud detectives at the Police Force Criminal Investigation Department (FCID) in Abuja unearth fresh clues in the ongoing probe into the recent N21million scam for which three of his close aides were held.
In fact, the investigators have recommended that Ehindero be asked to refund N37million which the erstwhile Commissioner of Police in charge of Budget, Mr. John Obaniyi, was said to have withdrawn on his orders.
Daily Sun checks revealed that the embattled CP Obaniyi and the ex-IGP have already given conflicting accounts on the purpose for which the money was withdrawn, prompting the recommendation for refund of the money.
It was further gathered that the investigators’ conviction of a foul play with regard to the N37million was strengthened by the fact that while Ehindero claimed that the money was withdrawn for contingency, Obaniyi told his interrogators that he withdrew the money on the orders of Ehindero for the purpose of Public Relations (PR).
Ehindero’s claim is reportedly contained in a scanty type-written statement which he volunteered to the investigators by proxy, in which he was said to have denied knowledge of N157million which was allegedly carted away from the budget office at the Police Force headquarters annex Lagos, on May 26, 2007, in nine Ecolac boxes.
Sources said the money was part of a huge sum left behind by Ehindero’s predecessor, Tafa Balogun in 2004, but had been instalmentally withdrawn until the fund depleted to N157million, which was carted away three days to Ehindero’s exit from office.
Although Assistant Commissioner of Police (ACP) Jelili, who was then at the helm of affairs at the Lagos budget office has reportedly admitted that the money was actually carted away, he denied knowledge of where the money was taken, and for what purpose.
Jelili, according to sources, has further stated that the total sum of money which he knew was a left-over of the Tafa Balogun administration at the Lagos budget office was about N360 million, although it is suspected that the money was over N600 million.
Interestingly, Ehindero is said to have denied knowledge of the entire sum of money, even as authoritative sources confided in Daily Sun that there are documentary evidence linking him to the withdrawals. He has equally washed his hands off the N21 million which was being ferreted away from the force headquarters before the bubble burst, saying the money was supposed to be handed over by Obaniyi to the new CP budget.
The investigators have also beamed their searchlight on a N70 million and N20million which were separately withdrawn from the N1billion given to the police for the last general elections for the purchase of vehicle spare-parts and fuel respectively, besides the N60 million which Ehindero allegedly allocated to himself as election duty allowances.
So far, the investigators have established the supply of some vehicle spare-parts to the police works department even though the exact amount used is yet to be verified as being up to N70 million, but the N20 million worth of fuel bought for the use during the elections had allegedly not been delivered as at last week.
In the meantime, investigators have intensified efforts to establish the whereabouts of the N157 million carted away from the budget office, indicating that the last may not have not been heard about the N21 million saga.
“Yes, the investigators are working seriously to unravel all that actually happened. Right now, they want CP Obaniyi to come and give further clarifications on the N157million, but he is nowhere to be found. He hasn’t shown up. We hope he will come and answer the questions.
“Again, it is true that the investigators have recommended that Ehindero be asked to refund the sum of N37million which Obaniyi claimed was withdrawn for PR on his orders. Since Obaniyi said he acted on his orders, it means both of them will have to refund the money”, said a source close to the office of the Ag. Inspector General of Police, Mike Okiro.
However, Ehindero has denied knowledge of the N37 million PR money and other issues in a telephone interview with Daily Sun at about 5.15pm on Sunday.

Assistant National Auditor of the Peoples Democratic Party (North Central) Dr. Godwin Daboh Adzuana has criticized the emergence of former President Olusegun Obasanjo as Chairman Board of Trustees of the PDP.
He also describes the recent declaration of assets by President Musa Yar’Adua as commendable and urged other public office holders to emulate him. And then the big one: Daboh says Obasanjo is worth N180 billion in shares, fixed and immovable assets. True? Well, we can only challenge the former president to declare his assets publicly to prove or disprove it.
The emergence of Obasanjo as BOT chairman of PDP
The position here is that I am concerned that Obasanjo is not a fit and proper person to be the chairman of the Board of Trustees of the PDP.
The Obasanjo era in Nigeria has been an era of pain, an era of tears and era of deprivation. An era of vindictiveness, an era of callousness. I cannot understand. I am a party loyalist but the point here is that the emergence of former President Obasanjo as chairman of the PDP Board of Trustees has potential disaster to our party. Thank God that the PDP is a very solid party. But I am sure that there is no way the majority of members of the PDP can accept Obasanjo as the chairman of the Board of Trustees.
With the damage Obasanjo has done to this country, the best thing he could have done is to go back to Ota and look after the billions that he has amassed. I am a leader of the PDP, but I am opposed to Obasanjo’s emergence because the decision to make him chairman was taken by 25 members of the Board of Trustees while the Board of Trustees is made up of over 80 members. Only 25 sat down and took that decision. And I want to appeal to Mr. President that as a man of due process, for such fundamental change to take place in the PDP, you must have a full house.
Even though Obasanjo was going to emerge, the meeting was fixed for 8pm, suddenly Obasanjo changed it to 1pm. I know at least 11 members of the Board of Trustees who were taking flight, planning to arrive Abuja by 4pm. And by the time they arrived the meeting had been completed. This is unfair. The point here is that our party has come to stay.
It is the only political party that is from the kindred to the national level. But under a Yar’Adua presidency, Yar’Adua is now the leader of the PDP. He must ensure that in election and in anything that is done, due process is followed. The meeting of the Board of Trustees did not form a quorum. And I remember that the president promised Nigerians that under his administration, due process has to be followed. For me, the election of Obasanjo as Board of Trustees chairman is a temporary thing, he cannot remain there.
There is no way we can allow him to do what he did in the federal government. The leader of the PDP is the national chairman and not the Board of Trustees chairman. The constitution is specific about that, so there is no amount of manipulation by Obasanjo or his cronies that can change it. I want to say that, for Nigeria to move forward, there has to be clean break politically and governmentally from Obasanjo. He is a student so, he should go and concentrate on his studies and write his memoirs and enjoy the wealth he has acquired for the past eight years. He should leave us alone.
Yar’Adua’s declaration of assets
When I told people in November last year that Yar’Adua is the president that this country deserves and is going to get, people thought it was a joke. Look at how the man has declared his assets openly. Everybody knows what Yar’Adua is. You can see a man who had been a governor for eight years worth less than one billion, himself and his wife. I know of some governors whose wives are worth more than N5 billion. For the first time in my life, I am proud to be a Nigerian.
This singular act of the president deserves commendation and emulation. And by this, all the governors, the vice president and every public officer must declare his assets and it must be done this month. When I knew the night before that the president was going to declare his assets, I sat down that day and took a full bottle of red wine even though I have not been drinking for a long time. I knew that something great was about to happen. Since our independence in 1960 this is the first time that we got a president, a realistic leader.
For example, my own intelligence sources have told me that Obasanjo is worth over N180 billion assets, in shares and other things. How much did he have when he was going to stand election? When Babangida went to meet him then, he said he had N20,000 in his account in 1998. Today Obasanjo is worth more than N180 billion in terms of assets, fixed and immovable assets, almost N200 billion.
Anenih cannot continue as chairman, Board of Trustees
I am not supporting the continuation of Anenih as the chairman of the Board of Trustees. He has been there for a long time. He is also responsible for some of the problems that happened. For example, the PDP took a decision to field David Mark, he went around, mobilizing governors and other people to go contrary to the decision of the Board of Trustees, and the decision of the National Executive Committee of which he was present at the meeting where the choice of David Mark was made.
He now turned himself and became the center of campaign for George Akume. He misled former Governor Akume and in fact, I was going to report him to the party and request that Anenih should be tried and sanctioned, because he breached a fundamental rule of the party. Which means that whether you agree or not with the party’s decision, you are bound to comply with it.
Once the majority has taken a decision, you don’t have a choice as a member of the PDP. But the party took a decision to zone the senate presidency to the north central and to a particular senator, David Mark, but Anenih became the center of campaign for Akume which was anti-party activity.
No other chance for Obasanjo
No, we need a break from the Obasanjo era in the party and in governance. And I know very well that Obasanjo cannot manipulate Yar’Adua. The Yar’Adua that I know is a man of integrity and today, every Nigerian is proud. And I take this opportunity to appeal to the opposition parties to withdraw their various petitions, join a government of national unity so that this country can move forward. I know that Yar’Adua has zero tolerance for corruption.
He is not the kind of man who will steal public money because he is a decent man who lives by what he has. Going through his assets declaration, are you not proud? I know some governors who are worth over N20 billion, but here is a humble man for him to have publicly told Nigerians who he is. And I can assure you that since the open declaration of his assets, everybody has been hailing him and most people are saying, let’s give this man a chance.
God loves Nigeria after all and in the midst of all the evils we are sorrounded with, he has brought out a man who people say has integrity to be President – in the name of Yaradua. This same God loves Ondo State and in the midst of the evils we are sorrounded with in Ondo State he will still bring out a man of integrity to be the Governor and this is in the person of Mimiko. Yes Mimiko is a man who will be able to declare ALL assets when sworn in as Governor and who even if he is governor for 4, 8, 0r 12 years will declare his outgoing assets, give account of all monies allocated to Ondo State and not enrich himself overnight or squander both the monies and lives of the people of Ondo state.
I did urge us all to give Yaradua a chance, we should now channel our efforts towards pressing him to speed, supervise and ensure that the law abiding citizens of Nigeria who did not go the way of violence but of peace and order by heeding the advice of the government in Nigeria and seeking a redress via the Electoral Tribunal are not cheated a second time. Such are namely Mimiko, and Mimiko, and Mimiko.
I CHALLENGE AGAGU TO DECLARE HIS ASSETS NOW AND COMPARE THIS TO WHAT HE HAD 4 YEARS AGO AND CONVINCE US IN ONDO STATE THAT HE EARNED OR WORKED FOR HIS ILL BEGOTTEN WEALTH, AND DONT FORGET WHAT HE DECLARES WILL NOT INCLUDE ALL BILLIONS SPEND BRIBING PEOPLE, DRINKING ALCOHOL AND PAYING BABALAWOS.

THE Ondo State governor, Dr. Olusegun Agagu, on Tuesday said his trip to Dubai, United Arab Emirates, was not to meet with the former vice president, Alhaji Atiku Abubakar, over the proposed Government of National Unity (GNU) being proposed by President Umar Yar’Adua.

Agagu, however, said he coincidentally met Atiku in the United Arab Emirates during the trip.
The governor, who spoke with journalists in Akure, added that the trip was made to understudy the free trade zone in Dubai reputed to be the most successful in the world.
Some leaders of the Peoples Democratic Party (PDP) had met with Alhaji Abubakar during his holiday in Dubai over the possibility of joining the GNU.
But the former vice president and other members of the Action Congress (AC) rejected the move.
Agagu said the two occasions he met with Alhaji Abubakar were coincidental, because the first one was at a Chinese restaurant and the other, at the airport when he was on his way back to Nigeria.
He said contrary to the speculation that he ran away from the country, the trip was taken to open the economy of the state to the international market with the instrumentality of the Olokola Free Trade Zone.

EFCC quizzes Kalu, Turaki

Former Governors Samiru Turaki (Jigawa) and Orji Uzor Kalu (Abia) have been arrested by the Economic and Financial Crimes Commission (EFCC), accused of corruption and money laundering.
They were arrested in Abuja, the EFCC said on Wednesday.
It had invited almost all of the 36 former Governors for questioning over graft allegations.
Kalu and Turaki, now a Senator, were the only two who refused to turn up, the EFCC said.
Sule Lamido, who succeeded Turaki as Governor, recently alleged that he left him an empty treasury when he term expired in May.
Turaki denies the charge and says his successor is merely “playing politics”.
The EFCC has also accused Kalu of money laundering and of diverting public funds into family businesses, accusations he too denies, with a threat to begin contempt proceedings against the EFCC over his arrest.
His spokesman, Iyke Ekeoma, said in statement on Wednesday that his lawyers have filed a notice of consequence against the EFCC after which contempt proceedings will be taken “if they fail to respect the rule of law”.
He argued that Kalu was merely extended an invitation, which he accepted, but that his boss questions the propriety of the action.
The statement reads: “(Kalu), who was on his way back from the United States of America, obliged the invitation as a fullfilment of an earlier invitation by the body to answer to some allegations.
“We view the manner of the invitation by the EFCC, this time around, as an affront to judicial proceedings. This is in view of the fact that there is a subsisting court order restraining (it) or any of its agents from harassing, intimidating or arresting (Kalu). Since the EFCC cannot operate outside the law, this latest invitation should be considered a flagrant disobedience to court order”.
However, news of Turaki’s arrest spread in Jigawa like wild fire on Wednesday afternoon. Civil servants jubilated. They said his tenure did not favour them.
Lamido’s Chief Press Secretary, Adgbo Onojah, narrated that it is no longer a rumour that Turaki is a guest of the EFCC.
But he declined to give details of the arrest since “the EFCC is a federal body and I cannot speak for them, though they have been here to do their work”.

Tribunal grants Mimiko’s request to quiz Agagu

AKURE—The Justice G.M. Nabaruwa led Election Petition Tribunal sitting in Akure, the Ondo State capital yesterday granted the request of the governorship candidate of the Labour Party (LP) in Ondo State, Dr. Olusegun Mimiko to interrogate the state governor Olusegun Agagu on the authenticity of the voters register used for the April 14 elections in the State.
The tribunal however asked the Labour Party candidate “to reapply for the interrogatories based on the ruling of the court before it could be effective.
Delivering ruling yesterday at the resumption of the hearing of the petition, the tribunal “held that the governor could only respond to the interrogatories either personally through his lawyer or through anybody duly authorized by him.
However Justice Nabaruwa declared that “the interrogatories should be delivered within the next three days to Agagu by his counsel.
He also ordered that the governor “should reply to the questions raised through sworn affidavit to be delivered to the tribunal by his counsel within the next five days.
Counsel to the LP’s candidate, Dr. Olamide Ayeni, had prayed for an order granting leave to him to deliver interrogations in the form dated and filed on June 23 for the examination of the Agagu and an order deeming the form of interrogatories already filed and served on lawyers of Agagu to have been properly delivered to the incumbent governor.
Mimiko also prayed the tribunal for an order directing the governor to deliver his answer to the questions raised in the interrogatories within three days from the date of the order of the tribunal.
The LP governorship candidate had in his petition before the tribunal “alleged that there were irregularities in the election held in many parts of the state particularly in the South Senatorial District of the state.
But the governor in hie defence disagreed and argued that the election in his district were free, fair and devoid of irregularities.
Agagu pointed out that the registered voters that were supposed to vote actually voted and this was indicated in the voters’ register of Independent National Electoral Commission (INEC).
However Mimiko in an affidavit in support of his application wanted the court to compel Agagu to explain the voters’ register he was referring to.
Dr Agagu counsel Chief Kayode Olatoke,opposed the application arguing that the tribunal has not issued pre-hearing conference notice.
Olatoke added that pleading had not closed since the INEC had not filed its reply to the allegations made against it by Mimiko in his petition.
Giving its ruling over the matter, the tribunal “held that pleading had been concluded since INEC had withdrawn its application seeking extension of time to file its defence.

Agagu denies stopping Deji from meeting with Yar’Adua

AKURE — Governor Olusegun Agagu yesterday denied lobbying out the Deji of Akure Oba Oluwadare Adesina for a meeting between President Umaru Yar’Adua and traditional rulers.
Oba Adesina had reportedly protested that the governor preferred the Amapetu of Mahin Oba Lawrence Omowole who is the present Chairman of the state Council of Obas to him despite the fact that he (Oba Adesina) was specifically invited by the Presidency for the meeting.
The two traditional rulers however left Akure, the state capital, yesterday, for the meeting expected to hold at the villa in Abuja.
Before leaving the state capital, Oba Adesina, vowed that not even the governor could stop him from attending the meeting with the President, as he accused the governor of opposing his selection by the Presidency to represent the state at the meeting.
But the state governor yesterday denied that he was against the Deji of Akure attending the meeting with the President.
Speaking through his Information, Orientation and Mobilisation Commissioner, Chief Eddy Olafeso, Dr. Agagu said that the allegation by the Oba against the governor “was so far away from the truth and it is a complete misinformation”.
According to him, the governor never discussed the matter with anybody in the Presidency but that it was the Ooni of Ife, Oba Okunade Sijuwade, who asked the governor to send the Chairman of the Council of Obas in the state to represent the state at the meeting with the President.
Olafeso said that the governor thereafter informed the Amapetu who is the Chairman to represent the state at the meeting.
“Governor Olusegun Agagu never lobbied anybody in or out; in fact, the governor is not at war with either Oba Adepoju or anybody in the state,” he said.
The Commissioner said that the governor was surprised that the Oba could go to press on the issue instead of confirming from him first.
Olafeso declared that the Amapetu remains the choice of the state because of his position as the Chairman of the state Council of Obas.
Vanguard gathered that attempt by other obas to mediate in the cold war between the governor and the Deji met a brick wall as the Oba said that the governor deliberately opposed his selection.

Ehindero Indicted, Obaniyi For Sack •Yar’Adua Receives Report

Investigators of the N21.6 million fraud in the police have, in their report, concluded that former Inspector General (IG), Sunday Ehindero, engaged in a “criminal breach of trust with intent to convert the money”.
Acting IG, Mike Okiro, confirmed in the report he forwarded to Aso Rock that the Force Budget Section is infested with shady deals, including financial misdeeds.
He pledged to arrest all of that.
The report found Commissioner of Police (CP), John Obaniyi, guilty of negligence, breach of public trust and intent to conceal the money; with Okiro predicting his sack on the recommendation of the Police Service Commission (PSC).
Okiro is silent, however, on what punishment would be meted to Ehindero, but stated that the N21.6 million was contingency fund for the 2007 elections, including operations at tribunals.
He accused Ehindero and Obaniyi of cover-ups in the scandal that drew criticism and jeers from opposition parties.
Lai Mohammed, Action Congress (AC) spokesman, had accused former President Olusegun Obasanjo of buying over the security agencies in shenanigans that told the lie of his war against greed and graft.
Obaniyi manned Force Budget Section until June 7 when the Criminal Intelligence Bureau (CIB) blew the whistle on the scam; after his driver, Elisha Augustine, and personal assistant, Olu Monday, were arrested for illegal movement of cash.
The CIB uncovered large sums stuffed in empty cartons and closed files in a store room, triggering finger-pointing among top police officers. Ehindero equally gave his own excuses, then denied any wrongdoing.
“Further to my interim investigation report … dated 15th June, 2007, I submit to (the President) the investigation report into the case of alleged conspiracy, breach of trust, theft, corrupt practices and stealing by public officers,” Okiro said in the report.
“In my earlier report, I had intimated (you) of the conduct of … Obaniyi who, against financial regulations, had kept in a store room files and empty cartons containing … N21,650,000 which should have been lodged in a bank or secured in a safe.
“The erstwhile IG, in his statement to the investigating team, had averred that the said amount should have been a subject of handing and taking over between the outgoing and the incoming CP budget. This non-disclosure of the facts of the sum, even when I confronted him (Ehindero), is tantamount to criminal breach of trust with intent to convert the money”.
Obaniyi, on suspension since the start of the sleaze, is accused of negligence, discreditable conduct, and conduct prejudicial to discipline.
Okiro said failure to hand over the money to the new CP Budget – as appropriate – implies that Obaniyi was up to a game.
“(Obaniyi)’s matter would be determined by the Force Disciplinary Committee and obviously shown (the way) out of the Force, as the Force cannot accommodate such a dishonest officer who has assaulted our rules with impunity.
“However, this recommendation will have to wait for the ratification of the Police Service Commission, which is yet to be reconstituted, following the expiration of the five years mandatory tenure of the former Commission ….
“The case file has been sent to the Legal Department of the Force, to ascertain if there is enough prima facie evidence to activate judicial process against the officer”.
Okiro pledged to curb such practices. All officers linked with the scandal have been posted out of the Budget Section.
Those posted to the section are to be rotated regularly to prevent them from mastering the system – which Okiro thinks facilitated the fraud.
And “only professionally trained personnel with high moral credentials will henceforth be posted to work in the section”.

OAU students petition tribunal over April polls result

OSOGBO—Students of Obafemi Awolowo University (OAU) Ile-Ife, have petitioned the Election Petition Tribunal sitting in Osogbo over the 30, 000 votes declared by Independent Electoral Commission (INEC) for the institution during the April 14 Governorship/House of Assembly election describing it as fraudulent.
In the petition addressed to the Chairman dated 31 July 2007, copies of which were made available to newsmen in Osogbo weekend, the students argued that the votes said to have been garnered in the school could not have been true when students were not around during the exercise to cast their votes.
The petition signed by the principal officers of the students union stated that there was no way “the INEC could have gotten such outrageous number of votes from the campus that was shut down on the 28 of February and the students were told to vacate the campus within three hours while mobile policemen were used to complete the sweeping the second day.”

Tribunal strikes out Ondo DPA’s petitions against PDP

AKURE—THE Election Petition Tribunal sitting in Akure the Ondo State capital, yesterday, struck out two different petitions filed by the Democratic Peoples Alliance (DPA) against Peoples Democratic Party PDP and two of its members in the state House of Assembly over the April 14 polls.
Chairman of the tribunal Justice G. N. Nabaruma in his ruling in Akure in the petition brought to the tribunal by the DPA to challenge the election of Samuel Adesina representing Odigbo state constituency 11 and Oye Aladetan in Ilaje constituency 1, declared that the tribunal lacked jurisdiction to entertain the suits, as they were statute barred.
Also, yesterday the tribunal dismissed INEC’s petition against the tribunal’s Order allowing the Labour Party in the state to inspect and scan ballot materials used during the elections.
The order granted to Dr Olusegun Mimiko, according to the tribunal was to allow him inspect, examine and make copies and scan through electronic device all the materials and documents used by the commission for the April 14 governorship election.
The tribunal ruled that the order was granted according to the provisions of the section 159 of the Electoral Act 2006. As regards the petitions that were struck out the tribunal said that the party and its candidates filed the petition after the required date sated in the 2006 Electoral Act.
Tribunal dismisses INEC application against minister

The election petition tribunal in Ondo State on Wednesday struck out the application brought by the Independent National Electoral Commission (INEC) to set aside an earlier order granted to the governorship candidate of the Labour Party (LP) in the state, Dr. Olusegun Mimiko.
The tribunal said the order granted to Mimiko was to allow him inspect, examine and make copies and scan through electronic device all the materials and documents used by the commission for the April 14 governorship election.
Justice G.N. Nabaruma-led tribunal ruled that the order was granted according to the provisions of the section 159 of the Electoral Act 2006.
The tribunal had on June 18 granted the order, while the INEC filed a motion on notice on July 27, praying the tribunal to set aside or vary to exclude scanning of the materials electronically.
Counsel to INEC, P.O. Jimoh-Lasisi (SAN), also argued that the tribunal lacked jurisdiction to make such order, as it was not contained in the Electoral Act, adding that the Evidence Act also did not provide for scanning of materials.
He said the respondents were not served with copies of the motion before it was granted to Mimiko.
But counsel to the petitioner, Dr. Olumide Ayeni, said the application was misconceived and should be struck out by the tribunal.
Dr. Ayeni said section 5(a) of the Evidence Act permits the tribunal to admit evidence from other sources, saying that the tribunal had power to make the order and should be sustained.
He referred the tribunal to the Black Law Dictionary for the meaning of “inspect” and “scanning” as far as the order was concerned.
Striking out the INEC’s application, the tribunal said it was granted based on the provisions of the section 159 of the Electoral Act.
It also noted that the time between the granting of the order and that of the filing of INEC’s application was too much in an election petition, where time is very essential.
The tribunal said, “we hold that the order is sustained, as the only option opened to the applicants, is to go to the Appeal Court to have the order set aside.”
Meanwhile, the tribunal has struck out two petitions filed against the Peoples Democratic Party (PDP) and its candidates in the April election.
The petitions were filed by the Democratic Peoples Alliance (DPA) over the House of Assembly election.
The DPA challenged the election of Mr. Samuel Adesina representing Odigbo Constituency II and Oye Aladetan, who was returned as the winner of the election into the house from Ilaje Constituency I.
The tribunal ruled that it lacked jurisdiction to entertain the suits as they were filed after the 30 days required by the 2006 Electoral Act to file the same.
The DPA’s candidates in the election, Samuel Ogunwomiju and Francis Ogunfeyimi had filed the petitions challenging the results of the elections, arguing that they were marred with irregularities and non-compliance with the provisions of the Electoral Act.

My life is in danger, Mimiko’s lawyer tells tribunal

A counsel to the Labour Party in Ondo State, Dr. Olumide Ayeni, has raised the alarm over death threats to his life.
Ayeni, who is a member of legal team of the LP Governorship Candidate, Dr. Olusegun Mimiko, said this during the proceedings at the election petitions tribunal sitting in Akure on Monday.
The lawyer said that he had been receiving death threats from some unknown persons in recent times.
He told the tribunal that some people whom he believed were out to harm him had been trailing him since Friday.
The lawyer who was escorted to the sitting by private security guards added that the people trailing him also forced their ways into his hotel room in Akure at the weekend. He said that he had been living in a hideout since the incident.
Ayeni’s alarm came two days after the house of Chief Wole Olanipekun (SAN), Mimiko’s lead counsel was torched by yet to be identified persons.
He prayed the tribunal to grant him some days adjournment in order to go to Abuja to make a formal complaint to the Police authorities.
According to him, the Abuja trip will allow him and the other members of the team to personally present their complaints to the Police Headquarters and demand for police protection.

Militants demand N500m from Agagu

Some militants operating in the Niger-Delta have demanded N500m from the Ondo State Governor, Dr. Olusegun Agagu.
The demand was made by the Movement for the Emancipation of Niger-Delta (western fringe) in a statement issued by one Chief Ibeseikumo Biku and distributed to journalists in Akure on Thursday.
According to the unsigned statement by Biku, “the money will be used to demobilise stranded militants allegedly recruited to vote for Agagu during the April poll.”
He said, ” We demand in strongest terms the sum of five hundred million naira (N500m) to immediately dispatch the stranded youth in the camp back to their respective places from where they were mobilised.”
Biku who is referred to as the general officer commanding the militant group said that over 500 militants were mobilised from the entire Niger Delta (i.e. from Akwa Ibom to Ondo State) to ensure Agagu’s success at the poll.
Biku claimed that some Ijaw leaders in the state, like the Secretary to the State Government, Mr. D.I. Kekemeke, Mr. Kingsley Kuku and others represented the governor in reaching the agreement with the militants.
He said that the people of Ese-Odo would not have voted for Agagu if not for the assurance they were given by these notable Ijaw leaders in the area.
Biku also warned the Ijaw leaders whom he said represented the governor to stay away from ”our territory as we declare them wanted.”
He added that the militants had concluded plans to teach the negotiators and the state government a very bitter lesson any moment from now.
“The arrangement on the ground are such that will not only embarrass the government but is capable of forcing Dr. Agagu to pack out of the state. The government should not forget too soon that we have duplicates of all the results of the elections that took place in our camp. If that happens the government should take the blame,” Biku said.
But the Governor denied ever reaching an agreement with the militant group nor any group for his re-election.
The governor who spoke through his Chief Press Secretary, Mr. Yemi Olowolabi, to our correspondent on the telephone said that he did not need to sign any pact with any militant before winning an election.
According to him, the governor did not enter into any agreement with the militants either by himself or by proxy.
He said, ” Dr. Agagu cannot and does not need to enter into any agreement with any body before he wins elections. The people of Ese-Odo Local Government Area voted massively for the governor on the account of his excellent performance which have brought about transformation in the lives of the people. The issue of the governor reaching an agreement with the people does not arise at all.
“Here is a government which tarred over 600 kilometres of roads in about four years, this is unprecedented. He constructed a road to link the Ese-Odo with the upland. He did the same in Ilaje Local Government Area. Ondo State is also the most peaceful oil-producing state in Nigeria, this is so because of prevalence of justice and equity in the management of the oil resources. Honestly, there was no need for such agreement.”

Hoodlums disrupt Ondo Assembly over N15m scam, guest house

MANY members of the Ondo State House of Assembly threw finesse to the winds yesterday, bolting through windows and scaling fences to escape the wrath of suspected political thugs.
The suspected hoodlums, armed with dangerous weapons including guns, charms and cutlasses, had stormed the House, demanding answers to unresolved questions over a ‘phanthon’ guest house project and the N15 million meant for its construction.
The Guardian learnt that the House has been engulfed in controversy over a guest house said to have been completed at a cost of N15 million by the immediate past legislators.
However, up till yesterday, neither the building nor the N15 million spent on it could be traced.
The N15 million was alleged to have actually been used for the Governorship and House of Assembly elections by the immediate past legislators.
However, having apparently gotten wind of the fraud, suspected hoodlums who were used to execute the last general elections besieged the house demanding their own share of the money as their remuneration.
Eyewitnesses told The Guardian that the Leader of the House, Mr. Kunle Agunbiade, got a raw deal from the miscreants who accused him of failing to fulfil his promise to set aside money for their promised monthly stipend.
It was gathered that it took the intervention of the Speaker of the House, Mr. Olufowobi Bakkita Bello, to save the situation. He promised to look into the grouse of the hoodlums.
Some of the scared legislators, who spoke to The Guardian, admitted that the issue of the N15 million guest house had been discussed in the House several times without resolution. They confirmed that both the money and guest house were nowhere to be found.
“We are trying to find out how the money was utilised and those responsible for the disappearance of the funds. We are going to make those behind the scam cough it out because it was meant for the members of the House,” one of them said.
