Election petition tribunal sitting in Akure, on Monday, threw out the application of the Ondo State Governor, Dr. Olusegun Agagu, praying the tribunal to quash the petition of the governorship candidate of the Labour Party (LP), Dr. Olusegun Mimiko, over the election.

Besides, the tribunal fixed October 23 and 24 for definite hearing of Mimiko’s petition, praying the tribunal to nullify the result of the April 14 governorship polls as declared by the Independent National Election Commission (INEC).

Agagu, through his counsel, Lateef Fagbemi (SAN), in the application prayed the tribunal to decline jurisdiction on the petition.

The governor preliminary objection asked the tribunal to dismiss Mimiko’s petition for non-compliance with the Electoral Act 2006. This, he said, made the tribunal to lack jurisdiction to entertain it.

He added that Mimiko, in his petition, did not join necessary parties and that the petitioner made specific allegations against electoral officers without joining them as parties in the petition.

The counsel also said the petition should be quashed as it was incompetent since any averment complaining about the conduct of any electoral officer, who is not a party to the petition, is liable to be struck out.

Fagbemi asked the tribunal to delete the names of 15th to 18th respondents, who are the Nigeria Police and other security agents who helped to supervise the election, from the petition because they were not necessary parties and should not be joined.

But counsel to the LP candidate, Mr. Olumide Ayeni, told the five-man tribunal that the application was incompetent since the first respondent who filed the application had joined issues with the petition.

Ayeni argued that the petition had been vitiated by the joining of the officials of INEC, who were principals of the people whose conduct were complained of in the petition.

The triunal, led by Justice G.M. Nabaruma, while ruling on the petition held that since the petitioner had joined those he wanted to rely on as witnesses and they are agents of INEC, the petition could not be dismissed on that ground.

On the constitutionality of the petition, Justice Nabaruma said it was too early in the day to adjudicate on that.

The tribunal, which refused to delete the list of the security officers that participated in the election from the petition, held that the petitioner had complained about the conduct of these officials and they should be made to defend themselves.

On whether or not the relief sought by the petitioner could be granted, the tribunal held that it had powers under the electoral act to adjudicate on the relief sought by the petitioner.

In the report of the pre-trial conference read by Nabaruma, he said the tribunal had streamlined the number of witnesses to be called during the proceeding.

According to him, Mimiko would call 30 witnesses to testify on the conduct of the election, Agagu would call 50 witnesses, the PDP would be allowed to invite 20 witnesses, the police seven and the INEC six witnesses.

    ABEOKUTA—THE Ogun State Election Petition yesterday nullified the April 14, 2007 House of Assembly election in Ijebu-Ode and ordered the declared winner Olawale Hassan Alausa of the Peoples Democratic Party [PDP] to vacate the seat in the House with immediate effect.

    The Tribunal also ordered the Independent National Electoral Commission (INEC) to conduct fresh election for the constituency within 90 days of the judgment.

    All Nigeria People Party (ANPP) candidate in the election, Banjo Omotola Peters had after the declaration of Olawale Alausa as winner by INEC dragged the electoral body and the declared winner before the Tribunal asking for a declaration hat he was indeed the winner or a nullification of the election.

    Delivering judgment yesterday, Chairman of the Tribunal, Justice Haruna Tsamanni said that the five-member panel had to nullify the election due to the lackadaisical defence of the petitioner by the respondent and his counsel, Chief Otayemi.

    But the Peoples Democratic Party (PDP) in its reaction said that the party was going to appeal against the judgment within the next 72 hours.
    The party in a reaction by the Director of Organization, Mr. Deji Kalejaiye said “the ruling was on the point of Law, not on the arguments of the Respondent or the defence lawyer, but due to the ill health of the lawyer, Segun Otayemi who has since sent a letter to the court, but the court claimed ignorance of such letter hence the judgment.”

    Kogi State Election Petitions Tribunal on Tuesday, in Lokoja, nullified the election of Speaker of the Kogi State House of Assembly, Chief Clarence Olafemi, who was the Peoples Democratic Party (PDP) candidate for Mopamuro Constituency in the last general elections.

    In his one hour ruling, the tribunal chairman, Justice Ibrahim Maiketa Bako, said that going by the evidences and testimonies presented by witnesses before the tribunal, it was clear that there were large scale irregularities in more than 50 per cent of the 10 wards, where voting took place in the constituency.
    Also the tribunal chairman said that both the oral and written testimonies presented by the first respondent, Chief Clarence Olafemi, were laden with contradictions and could therefore not be relied upon by the tribunal.

    Justice Bako also ruled that the tribunal, having studied carefully the evidence, discovered that the PDP witnesses were not consistent in their testimonies, adding that it was established that they lied to the tribunal.

    It, therefore, nullified the election and ordered for a fresh election within 60 days after the ruling.
    The Action Congress (AC) candidate, who is the petitioner, Chief Ben Abereoran, had, through his counsel, Mr. Job Ohieku, challenged the election of the PDP candidate at the election tribunal, arguing that the election was marred with widespread irregularities and prayed the tribunal to declare him winner.
    Reacting to the ruling, counsel to the Speaker, Mr. Umar Mohammed, said his client was not bound to abide by the tribunal ruling, adding that the tribunal had no jurisdiction to rule on the matter since the petitioner had abandoned his case mid-way in the course of proceedings.

    In a press statement signed by the Special Assistant to the Speaker on Media and Public Relations, Chief Kola Toluhi, the Speaker expressed willingness to appeal against the ruling, saying the mandate given to him by the people of his constituency could not be subdued since, according to him, his opponent only filed complaints in respect of four of the 52 units in the constituency.
    Speaking with journalists, chairman of AC in Kogi State, Chief Mike Adeleye, said the tribunal’s ruling was just and fair and called for jubilation.

    He commended the judiciary for standing by the truth, adding that with this ruling, the AC and Nigerians were more convinced that the judiciary remained the last hope of the common man.
    “We are now assured that if the PDP steals our mandate, the judiciary will restore it back to us,” he said.

    COULD you throw more light on your reported manhandling by the police at the Election Petitions Tribunal?

    What was wrongly attributed to me at the tribunal will convince any doubting person the level the opposition in the state are going in their determination to destroy some of us and put the government in disrepute.

    I am being smeared with these campaigns of calumny and falsehood because enemies of the state government believe that I am a threat that must be eliminated for them to have their way. That was why they sponsored fake and baseless news against me. I am of the Peoples Democratic Party (PDP) and I came into the House on the platform of the PDP. Nothing will stop me from protecting and defending the party.

    But you were at the election tribunal on the day in question. Were you not?

    Two weeks to the day the fake news was reported, I had never attended the sessions of the tribunal. As the Deputy-Speaker of the Ondo State House of Assembly, I have security operatives and other officials attached to me. It is not possible under any circumstance for any policeman to ask me to come and open my booth. I have officials that would open my booth for me. At no time has any policeman ordered me to frog jump. The circumstance will never arise. It is unfortunate that some journalists allowed themselves to be used to write falsehood.

    The media all over the world is seen as a veritable instrument for development. In Nigeria, they have continued to live up to this expectation, but it is sad that we have this few bad eggs, who tried to drag the integrity of the profession to the mud.

    Didn’t reporters contact you before the story was published?

    Nobody contacted me. It is very unfortunate that the reports came were by these same reporters that have been coming to me and I have been treating them as brothers. I have tried to create a conducive atmosphere for us to interact. I am disappointed that those who claimed to be my friends could go ahead to write a story that is capable of destroying me without ensuring that they heard my side of the story.

    Are you saying that your experience has changed your view about the media?

    Not all, it has not and it cannot. The media is a very noble profession. In fact one of my daughters told me she wanted to be an engineer but I told her I wanted her to be a journalist.

    What I have just gone through would not change my belief. What I will advise practitioners, is that they have been given a unique job and an uncommon opportunity to mirror the society and they have a unique duty to mirror the society rightly. I have a humble background, I am therefore always modest in the way I conduct my life, but unfortunately people tend to mistake this for weakness, it is just unfortunate.

    Journalism is a noble profession. It is a selfless service to the society. Therefore, I am of the view that those of you who have staked their lives for the profession should b encouraged for many reasons. The risk associated with the profession is so high but the returns are small. If you look at it from that angle, you will know that t hose involved in the profession are those who are genuinely determined to serve their community and country.

    This is unlike other professions. If you are banker, you want to make money. If you are an accountant, you want to get rich quickly, but journalism is a service to humanity, it is made up of noble people though there are some bad eggs who are a disgrace to the profession. I must quickly point out that bad eggs are found in all professions, they are found in politics, we have bad accountants as well as bad teachers.

    Ondo: Police probe Mimiko’s attack

    SUNDAY KUDAISI, Akure

    Ondo State Police Command has said it was investigating the attack on Professor Mimiko, younger brother of Dr. Olusegun Mimiko, the gubernatorial candidate of the Labour Party Akure residence.

    Unknown hoodlums had on Monday night stormed the Oba-Ile, Akure residence of the former Acting Vice Chancellor of the Adekunle Ajasin University, Akungba-Akoko, and allegedly carted away vital documents.

    During the attack, two people, the maid and the security guard, Mr. Sunday Sanyaolu sustained serious injuries through matchet cut by the hoodlums.

    The hoodlums who ransacked the house for over five hours carted away valuables and subjected the family to a harrowing ordeal.

    The attack came barely two weeks after the Ondo State Chapter of the Labour Party alleged that the ruling Peoples Democratic Party (PDP) was planning to attack the homes of Dr. Mimiko and his sibling.

    Narrating her ordeal, the wife of the victim, Mrs. Mimiko, a Lawyer, told newsmen the hoodlums gained entrance into the compound at about 10pm on Monday evening.

    According to her, “they were shouting madam, open the door, we are police officers. When it dawned on them that I will not open the door, they broke the window and entered. They beat my maid, attempted to rape her and when she resisted, they inflicted her with machete cuts on the head.

    The hoodlums, she said later went out of control ransacking the whole place carting away documents and asking for money.

    “They specifically asked us to surrender the remaining part of the money with which we used to run the campaign against Dr Agagu to them. They also asked us to bring out guns and I told them that my husband is not a politician but an academic and that we don’t own guns,” she recounted.

    Prof. Mimiko who rushed back to Akure on Tuesday morning to thank God wondered what would have happened if he were home.

    Meanwhile, the Labour Party has condemned in strong terms the attack on the younger Mimiko’s residence, calling on the Ondo State police command and other security agents to get to the root of the matter.

    The party, in a release issued by its Director of Press, Mr. Kolawole Olabisi, regretted that the incidents was coming barely two weeks after it cried out over plans by the Special Adviser on Political Matters to the State governor, Chief Segun Adegoke and some acolytes of the government to attack Mimiko’s residence and that of his brothers.

    But in a swift reaction, the Peoples Democratic Party in the state urged the leadership of the Labour Party not to link the ruling party with the incident that happened at Dr. Mimiko’s residence.

    The Commissioner for Information and Orientation, Mr. Eddy Olafeso said it has become a terrible phenomenon for parties to link incident of armed robber to political attack and urged them to look beyond the realm of accusation of opponents.

    Confirming the incident, the image maker of the state police command, Mr. Adeniran Aremu said the command was investigating the matter.

    The Labour Party in Ondo State has raised the alarm that the state Governor, Dr. Olusegun Agagu, has begun a fresh move to take N10bn loan from a consortium of banks.

    The Chairman of the LP in the state, Dr. Olaiya Oni, raised the alarm in a statement made available to our correspondent in Akure on Monday.

    The fresh alarm is coming barely a month after a similar one was raised that Agagu was negotiating with some banks to take N30bn loan.

    However, the Chief Press Secretary to the Governor, Mr. Yemi Olowolabi, denied the LP’s claim on the telephone when our correspondent contacted him.

    The CPS said Agagu was noted for transparency and accountability and he would “not do anything that will ruin the economy of the state.”

    Oni had alleged that the state government began the move to source for the N10bn loan when it became inevitable that the N30bn bond it wanted was no longer possible.

    He said, “The state government had commenced the negotiation with about five commercial banks in the state to put together a N10bn domestic loan, which will not be very open to scrutiny by many outside regulating agencies.

    “The loan will go through once it is approved by the Ondo State Executive Council and the head offices of the commercial banks. Of course, the government-controlled House of Assembly will thereafter pass an imaginary supplementary Appropriated Bill to cover Dr. Agagu’s tracks as ever.”

    I beleive there is no quota system to calling of witnesses. It is possible that they waited to see how many witnesses that we have and presented more. Nevertheless, this will not matter for 1 credible witness of truth will overcome millions of lying theiving witnesses for God will confound the languages of evil doers as he did to the builders of the Tower of ~Babel in Jesus name. One with God is a majority. God is the only judge in this matter and God will see that justice is done on our behalf (amen).

Or to Silence Militants used to help cheat his way in during the last elections? AGAGU you have failed for no amount of borrowing or theiving or lying will save you this time around. And can I remind you that Obasanjo cannot save you now. He cannot even save himself o jareee. God will expose Agagu to the fullest in Jesus name.     AKURE—THE Action Congress (AC) in Ondo State yesterday alleged plan by the Peoples Democratic Party (PDP) in the state to infiltrate its rank with a view to destabilising it.

    According to the party in a communique after its senatorial meeting held at Okeagbe-Akoko in Akoko North West local government of the state reaffirmed its commitment to the agenda of the progressives in the state.

    The party declared that its members “appointed into boards and parastaltals by the state government are not representing the party”.

    The meeting which was held at the house of Dr Tunji Abayomi confirmed that Mr. Sola Iji remains the chairman of the party until the party holds its congress. The communiquéé signed by Alhaji Oloruntoba said that “some PDP elements in its midst are planning, in collaboration with the PDP government and ODIEC, to hold a purported congress of the party and impose their appointees on the AC in Ondo State”

    Apart from rejecting the planned convention that does not have the backing of the national secretariat, the party called on the security agents to be on alert to stop any action that may lead to breach of peace.

    The party warned against “goose chase” and said it would resist any attempt by the PDP to destabilize the party.

    The five-member tribunal, headed by Justice Ibrahim Bako, therefore, ordered the Independent National Electoral Commission to conduct a fresh poll in the state.

    The election was voided on the ground that the All Nigeria Peoples Party and its candidate, Alhaji Abubakar Audu, were unlawfully excluded from participating in it.

    Audu, a former governor of the state, was disqualified by INEC 24 hours to the election over his alleged indictment by a Federal Government panel.

    His name and picture, which had earlier been printed on the ballot paper, were crossed with red ink by INEC officials.

    But shortly after INEC announced Idris as the winner of the poll, Audu and the ANPP filed a petition at the tribunal, asking that the exercise be nullified.

    Delivering the judgment, which lasted about two hours, Bako said the issue of whether or not a condidate should be disqualified was not a matter for INEC to decide.

    He, therefore, declared, “The exclusion of the ANPP governorship contender is unlawful, ultra vires, null and void and cannot stand.

    “The return of the first and second respondents (Idris and Dr. Phillip Salawu) is hereby nullified in accordance with the provisions of Section 147 (1) of the Electoral Act 2006.”

    The Section reads, (1) Subject to subsection (2) of this section, if the tribunal or the court as the case may be, determines that a candidate who was returned as elected was not validly elected on any ground, the tribunal or the court shall nullify the election.”

    On the alleged indictment of Audu, the tribunal chairman held that government agencies such as INEC, the Economic and Financial Crimes Commission, and the Independent Corrupt Practices and Other Related Offences Commission lacked constitutional powers to order the disqualification of a candidate for an election.

    “It is only a court of law that can convict and disqualify a person on the basis of indictment,” Bako said.

    He added that Audu was duly sponsored and validly nominated by the ANPP, having won the party’s primaries.

    The judge wondered why INEC, which screened Audu and printed ballot papers with his name, photograph and party’s symbol, should turn round to disqualify him.

    “If it had not done that, it would not have found itself in this mess,” he added.

    Bako therefore ordered INEC to “conduct a fresh election for the governorship seat of Kogi State in accordance with the provisions of Rule 27(2) of the First Schedule of the Electoral Act, 2006.”

    Rule 27(2) states, “If the Tribunal or Court has determined that the election is invalid, then, subject to Section 147 of this Act, where there is, an appeal and the appeal fails, a new election shall be held by the Commission.”

    The fresh poll, said the tribunal chairman, must include Audu and the ANPP.

    Reacting to the judgment, Audu said, “God is a God of justice and He has been on my side.”

    Audu’s counsel, Dr. Alex Iziyon (SAN), who led a team of 12 other lawyers, also lauded the judgment.

    Izinyon said that the verdict was a landmark victory for the ANPP and the entire people of the state.

    INEC’s counsel, Mr. Oba Maduabuchi, commended the tribunal for the verdict. He hinted that his client might appeal.

    The governorship candidate of the Action Congress in the state, Alhaji Mohammed Ohiare, whose petition was, however, dismissed on Wednesday by the tribunal, hailed the nullification of Idris’s election.

    Ohiare, in an interview with one of our correspondents, said the development showed that the oppressed had the judiciary to turn to.

    “We are grateful to God for the judgment. Our judiciary deserves kudos and it is an indication that it can hold its own in the international community. We are happy that we have a judiciary that could correct our anomalies,” he said.

    But the Special Assistant to Idris on Media, Mr. Farouk Adejoh, said the state government was not surprised at the judgment of the tribunal.

    He claimed in a telephone interview that the state government got signals long before the judgment that the tribunal had been compromised.

    Adejoh, who added that the tribunal was in the state to do the bidding of Audu, said that Idris would appeal the verdict.

    He said, “We will definitely appeal. Our lawyers are already studying the judgment and we will appeal within the period allowed by the law. The judgment belongs to the dustbin and should be put in its appropriate place.”

    The governor’s aide alleged that Audu had at various times in June been reported by two national newspapers and a national television that the tribunal was in the state to void Idris’s election.

    He said, “We drew the attention of the tribunal to this but they did not do anything. As at 2pm on Tuesday, the governor’s lawyer was not aware that the tribunal would rule today (Wednesday).

    “The governor’s lawyer and that of the INEC were not in court but Audu’s counsel was there.

    “He (Audu) came in with many people from Abuja on Wednesday and they were all going about drinking and rejoicing. They knew what the verdict would be from the beginning.”

    A former Vice-President, Alhaji Atiku Abubakar, said the judgment was a vindication of his position that the April general election was not free and fair.

    Abubakar’s reaction was contained in a statement by his Media Consultant, Mallam Garba Sheu.

    He said, “The judiciary has done the nation proud by the tribunal’s decision to nullify the state gubernatorial election results.

    “I believe that more elected officials will tumble because there were no elections at all in most parts of the country.

    “The courts will continue to be the last hope for saving this democracy.”

    The impending election tribunal proceeding later on this month and the decision thereafter is crucial in many respect. For one thing in particular, it should act as a barometer as to whether there is indeed justice in Nigeria SINCE the inauguration of Yar Ardua as the leader of the Nigerian nation. He has come forth with pronouncements which suggests he is on the side of justice, fairness and transparency.
    We therefore await the outcome of the tribunal in Ondo state with much anticipation to see whether indeed a new beginning has been ushered in since Yar Ardua came aboard. If the result of the tribunal goes in favour of the individual who contrived along with others to deny the peoples will to predominate at the election back in April in Ondo, then we will know for sure that all the president’s comments and democratic posturing are nothing but a charade. This is based on the premise that without tampering s from within and outside the sate by those who hold the reins of power, we all know who will triumph at the tribunal. Roll on October 23 & 24th.

    The Action Congress (AC) has warned the Peoples Democratic Party (PDP) against any attempt at ridiculing Nigeria’s judiciary over the recent court judgments reversing the ‘victories’ of some PDP candidates in the last elections.

    In a statement issued in Abuja on Tuesday by its National Publicity Secretary, Alhaji Lai Mohammed, the party said the decision of a recent PDP meeting in Abuja,

    directing PDP governors with pending cases to “reach out” to the election tribunals in their states, was nothing but an attempt to denigrate the judiciary.

    “The PDP is wrong to assume that the party has been losing at the tribunals because the opposition has ‘reached out’ to the tribunals. The simple reason is that the injustice and illegality perpetrated by the party have finally caught up with it,” the AC said.

    The party said with the criminality allegedly perpetrated in the name of elections by the trio of former President Olusegun Obasanjo, PDP Chairman Ahmadu Ali and INEC Chairman Maurice Iwu, it was inevitable that woe would betide the PDP at the tribunals.

    It expressed shock at the report – hitherto not denied – that the PDP panic meeting held as presided over by President Umaru Yar’Adua, the apostle of the rule of law, constitutionality and due process.

    AC said: “The report that he did not utter a word throughout the meeting is even more baffling, since it indicated some sort of acquiescence with the evil machinations of the remaining holdouts of the Obasanjo era, who will stop at nothing to suck Yar’Adua into their camp.

    “President Yar’Adua should be reminded that it is against his much-bandied stand on the rule of law and due process to sit by while his party seeks to influence the tribunals, in an attempt to halt the party’s continuous descent into infamy over its widespread rigging of the last polls.

    “If President Yar’Adua has made any impact since assuming office in May, it is in the area of rule of law and due process. We believe he will not like to throw that away on the altar of political expediency.”

    The party, however, reiterated its avowed confidence in the Nigerian judiciary, irrespective of the “reaching out” attempt by the PDP.

    “The judiciary has shown, time and again, that it is indeed the saviour and bastion of our democracy. We have no scintilla of doubt that this arm of government will continue to live up to its reputation as the last hope of the aggrieved,” AC said.

    All Ondo state sons and daughters are keeping their fingers crossed that justice will be done in the outcome of the current tribunal going on in the state to deliberate and decide on who actually won the election staged back in April 2007.
    I heard on the AIT evening news earlier today that the tribunal will decide on whether to admit as evidence some documents put forward by the LP in their attempt to bolster their charge of a criminality by the PDP in falsifying the result. This hearing is coming up on the 16th of this month, next Friday actually. Further hearings, if I heard correctly, are slated for the 18th and then the 19th of November. It appears the tribunal is getting close to the point of coming up with its decision.
    I am passionately interested in this case because I am a stakeholder in that state, and as a result felt the state under the current governor has been moribund, which is why many Ondo state indigenes felt that a further 4 year stint by the present governor will literally bring Ondo state to its knee. I can go on ad infinitum on this but I shall stop at this point, suffice to say that we are all watching with keen interest and hope Justice Nabaruma will give the mandate to the rightful owner.

Truth is, further evidence or not there is more than enough to fault PDP’s claim to Ondo State Governorship election. Too many open evidences of ballot stealing, use of force, shooting and killings, paying militants to assist rig elections, and further promise of N500million which the Militants are still kidnapping PDP heads for; stuffing of ballot boxes, and worse still, declaring of Ondo State result in Abuja when the matter was still being sorted out in Ondo State to the bewilderment of the then INEC Chairman who had no choice but in the end to obey his master’s voice, OBJ, Babaiyabo, amidst police and army presence in Ondo State to coerce and frighten innocent citizens. The whole world saw and heard of all these. So how do PDP and Agagu think they will ever get away with this? All we want is justice. All we are saying, give us back our mandate and let Mimiko get down to the business of running Ondo State with his credible and far reaching plans for ALL in Ondo State. This suffering is just too much. We are sick and tired of Agagu’s gymmicks, empty words, unsubstantiated claims and hiding under Governorship Immunity because he knows he has a case to answer to EFCC. We are not fools in Ondo State.     Dearly beloved in Ondo State, patiently and as true patriots who really love Ondo State and Nigeria, we wait for the greatest news that Ondo State is awaiting and this is that the Mandate of Mimiko and as stolen by PDP/Agagu has been given back to its rightful owner. We pray daily for the truth to prevail and justice done. The God we serve is a good God who will not let the innocent suffer in vain and who will definitely visit the wicked with fire and brimestone (amen).

    Again, another one bites the dust. The Adamawa State Election Petition Tribunal yesterday nullified the election of the state Governor, Admiral Murtala Nyako (rtd) – the third governor to lose his seat at the tribunal since the April polls.
    Other governors who have lost at the tribunal are Kogi State Governor, Alhaji Ibrahim Idris, and his Kebbi State counterpart, Alhaji Saidu Dakingari.
    The Action Congress (AC) and its governorship candidate, Alhaji Ibrahim Bapetel, had petitioned the tribunal challenging the declaration of Nyako and Peoples Democratic Party (PDP) as the winner of the April 14, 2007 governorship election in the state.
    The party also protested the unlawful exclusion of Bapetel by the Independent National Electoral Commission (INEC) on the eve of the election.
    Delivering his judgment, Justice Oluwole Akinwalere upheld the prayers of the petitioners that Bapetel was unlawfully excluded from the elections by INEC and declared the election a nullity.
    Justice Akinwalere consequently set aside the election of Nyako and ordered INEC to conduct a fresh election for the governorship seat of Adamawa State within 90 days from the day of the judgment, at which the petitioners shall be given the opportunity of participation.
    He added that from the pleadings of the various parties in the petition and the evidence adduced, there was overwhelming evidence that the AC candidate was validly nominated, but wrongfully and unlawfully excluded from the said election.
    Justice Akinwalere, who came down hard on INEC, carpeted the commission for actions bordering on ineptitude and mischief as INEC’s plan to exclude the candidate, was “carefully conceived, painstakingly planned and clinically executed”.
    He said in more serious and accountable political climes, INEC should have showed remorse for the problem it had caused and the public money it wasted to organise an election it made inchoate even before it started.
    He stressed that INEC’s grandstanding was rather unfortunate, as a serious disruption was being caused to the governance of Adamawa State.
    Describing Nyako as a victim of INEC’s excesses and illegality, Akinwalere hoped that in future, the Electoral Act would be amended, so that all pre-election issues would be thrashed before the elections and post-elections litigations were concluded and before the declared winner was sworn into office.
    The judges of the tribunal departed Yola immediately after delivering the 64-page judgment.
    Reacting to the judgment, Nyako at a rally attended by PDP stalwarts such as Senators Jibril Aminu, Mohammed Mana, and the Minister of Culture and Tourism, Dr. Idi Hong, at the Mahmud Ribadu Square, said it was a welcome development.
    He said the ruling would enhance the growth of democracy in the country.
    While praising the country’s constitution and the Electoral Acts of 2006, he said it made adequate provisions for complaints to be entertained from losers, which would go a long way to lessen tension and acrimony in the polity.
    He said his election at the April 14 election was not a fluke, adding that it was gratifying that the tribunal found no wrongdoing or any shortcoming on his side but rather held INEC responsible for the entire “sad happenings”.
    Nyako stated that he might not contemplate going on appeal as he was ready and prepared to go back to face the electorate to show that he was fully accepted.
    Also speaking at the rally, Senator Aminu said the PDP was willing to go back to the poll to test its popularity again, as the party was sure that the Adamawa people had totally rejected the politics of the past as represented by the former Vice President, Alhaji Atiku Abubakar and his allies.
    He said if election was conducted 20 times in Adamawa, the PDP would win.
    Speaking after the judgment, Barrister Tayo Jegede, counsel to the AC governorship candidate, described the judgment as the vindication of the rule of law and justice and the entrenchment of democracy by the Judiciary.
    Chief Wole Akoni, SAN, counsel to Nyako, however said his clients would appeal the judgment. He commended the maturity and industry of the tribunal members.
    Atiku, in his own reaction, said the tribunal should have ordered the swearing in of Bapetel as the winner of the April 14, election.
    In a statement yesterday, he said the AC in the state would appeal the decision of the tribunal to nullify the election of Nyako without declaring Bapetel the winner of the election.
    “We commend the tribunal for its bold and courageous decision. At the same time, we are dissatisfied that they have not asked that the AC candidate, Ibrahim Bapetel, who won the election be sworn in as governor,” he said.
    The AC, Atiku said, won the election in Adamawa, despite the last minute disqualification of its candidate, Bapetel. He said the ballot papers were there in case there was a need for a recount.
    He, however, said the decision of the tribunal headed by Justice Olawole Akinwalere had reinforced his belief that the nation’s judiciary possessed the inherent capacity and will to right the wrongs unleashed on the people of Nigeria by former President Olusegun Obasanjo, the PDP, and INEC Chairman, Prof. Maurice Iwu, in the name of elections in April.
    The PDP has said it would accept the judgment because it could not go against the decision of a properly constituted court.
    The National Secretary of the party, Chief Bernard Eze, described the tribunal judgment as the concept of the rule of law, saying “We cannot go against the rule of law.”
    The AC hailed the judiciary for its continued efforts to ensure the sanctity of elections in Nigeria as well as the survival of the country’s democracy.
    In a statement signed by its National Publicity Secretary, Alhaji Lai Mohammed, AC commended the judiciary, while calling for the resignation of the INEC Chairman, Prof. Maurice Iwu, and the Chairman of Economic and Financial Crimes Commission (EFCC), Mallam Nuhu Ribadu
    Also reacting to the judgment, INEC said it had noted the judgment. “It is for the deepening of democracy in Nigeria,” it said.
    According to the INEC National Commissioner in Charge of Information, Mr. Phillip Umeadi Jnr., “the commission has noted the judgment of the Adamawa State Gover-norship Election Tribunal which nullified the election of Governor Muritala Nyako. The commission wishes to say that the judgment is for the deepening of democracy. It is in line that the exclusion was right of the commission to verify candidates as reiterated by the Court of Appeal which was taken away by the Supreme Court after the governorship elections of April 14.”

We have come too far and gone through too much to let last minute jitterbugs who know they are on their way out and are an extinct people. Ondo State is a state of mostly bold people and generally honest. Shame that a few evil minded lying thieves and mandate stealers aka Agagu planted themselves unwittingly on the people and are manipulating, stealing and lying their lives away daily. Oh just cant wait for Mimiko to be declared Governor so that Ondo State/Nigeria will see Governance with a difference, worthy of emulation and taking into account ALL peoples from all works of lives. I am happy that I am a Mimiko supporter to the core. Mimiko is an exemplary character, a rare breed, a patient and God fearing, people loving saint, and God will forever bless, protect, love and uplift him.     Govt: LP is planning to unleash violence on Ondo – That is baseless – LP

    THE Ondo State government on Sunday alleged that the Labour Party (LP) was planning to unleash violence on the state.

    It said the development was based on the ambition of the governorship candidate of the party in the last election, Dr. Olusegun Mimiko, to become the governor of the state at all cost.

    A statement by the Press Secretary to the governor, Donald Ojogo, said the government was not against anybody’s ambition, but such should be pursued with decorum.

    “The government does not, and will certainly not fault anybody’s ambition or aspiration to leadership in the state.

    “However, it is government’s primary responsibility to ensure that peace reigns without any inhibition. This is moreso that government believes in the sanctity of the judicial process as issues are determined only on their merit and not sentiments.

    “Be that as it may, government feels concerned over the displayed readiness of the Labour Party to unleash terror on the state in case its petition at the election tribunal fails to achieve the desired goal,” the statement said.

    It added that “as part of the script, the LP had, at the commencement of the court process, accused the Peoples Democratic Party (PDP) of setting aside N500 million to bribe members of the tribunal.

    “The public has also been inundated with false statements on issues. The erroneous impression being created is that LP is coasting home to victory at the tribunal.

    “LP’s strategy is meant to create tension where there is none, intimidate and blackmail members of the tribunal, discredit the government and give the public a wrong impression that the declaration of its governorship candidate by the tribunal is a matter of time.”

    The statement said the party was trying to pre-empt the final ruling of the tribunal as well as premeditate and justify violence in case the tribunal upholds the election of Governor Olusegun Agagu.

    But the LP described the allegation as baseless and worthless. It said that the people of the state had over the time known that the party was not a violent one “like the PDP.”

    The Director of Press of LP, Mr. Kolawole Olabisi, said it was the state government and its agents that had been fomenting trouble in the state since the April 14 governorship election.

    I wonder when Ondo State PDP will stop spreading rumours, trying to divert the course of justice and live up to the real world. A world where evil and lies will not overcome truth and justice. A world where people see daily with their own eyes how low and false the present government in Ondo State is, which is the reason why Ondo State citizens overwhelmingly voted in Mimiko as their governor during the April Polls. A world where even if you try to fool the people this will never be all of the time. A world where violence and trickery as perpetrated by PDP in Ondo State, while they try to blame other people all of the time, is no longer to be tolerated. We have for 8 months listened and read about so many PDP false accusations, lies about non corroborated stories of “projects” and what have you which Ondo State is yet to see, and where instead of showing the world they have something PDP Ondo State will always try to bluff and coerce. Time is running out for them and they are getting so desperate and will stop at nothing and even hit below the belt so as to save face. THEY HAVE FAILED. They have never had anything good to offer Ondo State and Ondo State, Nigeria and the outside world are all waiting (patiently) to see them packing.

    Tell me, where has LP been involved in violence in a state where Agagu and OBJ has tried to supress people with threats of police and soldiers. How many LP men have been arrested with guns, ballot papers, charms and amulets. How many have been accused of daylight murder e.g. the murder of some Ile-Oluji men by top PDP personnel, talk less of unsolved murders e.g. Awanebi, whose blood is crying out.

    Has LP been involved with militants? Have militants and area boys accused LP of owing them money whereby kidnapping top party men? Who was challenged to come an swear before a Riverine Oracle if it is not true that he has an unholy liaison with election riggers? Who is EFCC waiting to arrest and charged for Aviation theft?     A member of the Ondo State House of Assembly Abiodun Ogunbi was yesterday beaten to a pulp, and slumped as members of the assembly engaged each other in a free-for-all fight over the presentation and passage of the list of members of the State Independent Electoral Commission (ODEIC). Ogunbi who is the only member of the Alliance for Democracy (AD) in the assembly was reportedly hit by Thompson Atikase from Ilaje 11 constituency while he was trying to carry the mace.

    Yesterday’s deliberation ended abruptly as members escaped through different entrances in the assembly.

    About 50 mobile policemen were later drafted to the assembly as other workers in the assembly fled to different directions as tension was high.

    But Atikase denied the allegation, saying that he only cautioned Ogunbi of his un- parliamentary behaviour when he wanted to carry the mace.

    Mr Ogunbi is presently at Liberty Specialist Hospital at Oluwatuyi area in Akure as doctors are still battling to save his life as at the time of filling in this story.

    But in a swift reaction to the development in the assembly the Deputy Speaker Mr. Mayowa Akinfolarin confirmed that there was a rowdy session over the presentation of the list.

    Akinfolarin however denied that Ogunbi was hit with a charm but that he fell while attempting to carry the mace during a struggle, adding that he was drunk before coming to the Assembly yesterday.

    He said that Ogunbi would be suspended for his un-parliamentary behaviour when the Assembly reconvenes.

    The Speaker, Bakita Bello was reportedly dragged on from his seat to see the condition of Ogunbi who was said to be foaming from the mouth while blood gushed out from his ears and mouth.

    This is coming exactly a week after the House witnessed a rowdy session over attempt by the Speaker to present the list as forwarded by the governor, Dr Olusegun Agagu to the House for ratification.
    The contentious list was necessary for ratification to allow the council polls slated for December 15 hold.

    Justice Constance Momoh, Chairman of the Code of Conduct Tribunal (CCT) has disclosed that she received corrupt charges against 17 of the 36 state governors sworn-in in May upon consultation, however, the Tribunal decided to give them time to settle down to work first.

    Justice Momoh disclosed this to Government House correspondents in Owerri recently when she paid a visit to Governor Ikedi Ohakim of Imo State.

    “The Tribunal received numerous charges on about 17 of the newly sworn-in governors. Upon consultation, we decided to give them time. I decided not to issue summonses. Fortunately, your name (Gov. Ohakim) is not on the list” Momoh says.

    Justice Momoh who was viiting Imo State in respect of the suit between the Federal Government and Senator Ifeanyi Araraume said her Tribunal which moves it sittings across zones in Nigeria over 400 cases in Owerri zone.

    The zone also includes cases from treated Port Harcourt, Umuahia and Calabar. She said that contravention of rules is very rampant in spite of the rigidity of the laws of the Code of Conduct.

    Some of the common infractions according to her include non-declarance, “Many public officials are not alive to their responsibilities, many collect forms without filling them. There are over 1000 such cases in Plateau state. People must have acknowledgement from the Code of Conduct Bureau upon submission of their forms”, she advised.

    On the situation in Imo state, she said that, the Araraume case was still the only one noting that perhaps the Bureau was still processing others. She told her audience that the case could not go on as the defendant pleaded indisposition.

    The trial would resume in Abuja next year and remain their till the end.

Hope for a change and a brighter, better Ondo State and Nigeria. How? First all these thugs cum cultists who call themselves lawmakers and guardians of the state will be removed and replaced by correct, God fearing movers and shakers who with genuine love of the common people will govern with a difference. Now we see why Mimiko is our hope for change in Ondo State, for life must continue. For now it is true that most people in Ondo State are filled with trepidation and would rather give up. We must encourage them. God can and will change Nigeria and Ondo State. We have a new hope for a better beginning and we must all work to the realisation and actualisation of our dreams and desires. I am glad that these pretenders are showing their true colors. Imagine what they will be doing in months to come if now when there is so much uncertainty and concern they resort to blows, charms and confusion. Well headed by a confusionist what do we expect. They deserve no respect and should be booted out. Hope our truly elected governor Dr Olusegun Mimiko is following all these for there is a lot to do when he gets back his mandate. We must all assist and aid a truly democratic and progressive process of governance in Ondo state under our man Mimiko when the time comes, and this my people will be soon Insa Allau.     Dear Compatriots
    As we all go to church today and even to the Mosques (for many muslims also worship on Sundays), let us all continue to pray and petition God on behalf of the truly democractically elected Governor of Ondo State, Dr Olusegun Mimiko, the Labour Party, People of Ondo State and our country Nigeria. This coming week is a crucial week as regards the Pending Petition at the Tribunal. May our Lord Jehovah who will never forsake the righteous or allow evil to ever overcome good take total and absolute control of the affairs of Ondo State. You see, and hear daily of the atrocities being committed in Ondo State under the present fake Governor Agagu, and trust me, they do more evil behind the scenes, which will even make Abacha seem a saint. But Ondo State people are not fools (at least most of them), and we will continue to support and defend the just cause of the people to the end.

    The journey so far seems very long, but the end is very near, and we must keep the embers of justice glowing. Nigeria must not continue to be debased and abused, and every God fearing people must defend their corners. Ondo ~State is our primary concern and justice must be done so that all these evil people in our midst would be arrested and prosecuted for theft, embezzlement, corruption, juju and even murder in Jesus name.

    Tribunal: Appeal Court orders speedy hearing of petitions

    The President of the Court of Appeal, Justice Umaru Abdullahi, has directed presiding justices to treat appeals emanating from election tribunals with dispatch.

    Investigations by our correspondent showed that there had been delay in constituting panel to hear appeals from governorship election tribunals.

    The president of the court was dissatisfied with this delay and had sent memo to all the judicial divisions asking them not to delay appeals from election tribunals.

    At the Abuja division of the Court of Appeal, the court was yet to constitute a panel and fix hearing in the appeal by the Kogi State Governor, Alhaji Ibrahim Idris and the Independent National Electoral Commission, challenging the nullification of the state’s governorship election.

    The Kogi State Election Tribunal had on October 10, 2007 nullified the April 14 election of Idris.

    Two months after, the appeal by the governor had not been fixed and no panel was constituted to hear it.

    However, appeals on elections into states’ houses of assembly from Kogi, Nassarawa, Niger and the Federal Capital Territory filed at the appellate court in Abuja have all been slated for hearing in January.

    Apart from Kogi State, the governorship elections in Adamawa and Kebbi States had also been nullified.

    The court of appeal is the court for the final resolution of disputes over governorship election.

    Until the court of appeal has given judgment on the pending appeals, the governors of Kogi, Adamawa and Kebbi would remain in office.

    ONDO State governor, Chief Olusegun Agagu, was on Saturday admitted to the University College Hospital (UCH) private suites to correct a tendon related injury he sustained while playing lawn tennis inside the government house about a month ago.

    Nigerian Tribune gathered that the governor was referred to the UCH from Igbobi Orthopaedic Centre, where he initially had a minor surgery.

    A heavy presence of the governor’s men was noticed at the hospital and the surgery was said to be a success. In a telephone conversation with Mr. Kunle Atinwore, the hospital’s Public Relations Officer, he confirmed seeing a large Ondo State government team at the hospital.

    He was, however, unable to confirm the state of health of the governor, who underwent a surgical operation on Saturday.

    Efforts at getting to the manager and administrator of the UCH private suites were also unfruitful as the telephone lines were said to be busy.

    I am a politician and I see things a little diffrently. for some of us who have worked for and have known Dr Mimiko for a long time, we have become very coutious of traitors from within. I am not definitive here because I am not God. If we all want Mimiko as Governor in Alagbaka, then we must all be FULLY in his support whether we are with him or he is away from us. I became curious about Omotaylor’s repeated denial and subtle way of discoraging us from seeing the forum in question luckily Fred helped out by providing the link and from the contributions on that forum and the trend of discussion it is obvious that it is a place beeing visited by several people. So instead of us to come here and talk to ourselves we need to embrace the truth and take the battle to where the crowd is. We must not give the impression that we are confortable with shutting ourselves to the reality in the other side and live our flank unprotected. I have known supporters of Iroko who rain curses on our political foes but ended up being moles in our midst…. caution is the word

    not all us us possess the same web savvy as the young ones. I am not saying Omotaylor is not a Loyalist and I did not even know Omotaylor is a woman so I am very happy. I am saying that we should be very practical in this struggle. If you notice our approach at the tribunal, it has been very pragmatic which has made it difficult for the opposition to get escape route. If we have a straightforward information. We must give that information and allow all to make inputs. I came under the impression that the forum was one of those seddon visited forum when i read the exchange of post over it but the PDP has so carefully tucked the forum in the state website where thousnads of our schools boys and girls go to for scholashipps, results and waht have you so they have audience. our target should be to get the audience.     THE Ondo State Election Petition Tribunal sitting in Akure was on Saturday told how the Independent National Electoral Commission (INEC) allegedly used the materials of the defunct National Electoral Commission (NEC) to rig the last general elections in the state.

    The Labour Party (LP) House of Assembly candidate for Okitipupa Constituency II Mrs. Jumoke Akindele,while giving evidence at the tribunal, said NEC stamps were used on election results sheets in the area.

    Specifically, the petitioner told the Justice J.S Ikyeh-led tribunal about alterations on the result sheets, differences in the figures recorded in respect of number of registered voters and votes cast in the various polling units during the election.

    The documents that she relied on which had earlier been admitted in evidednce, constituted the results from polling units in Okitipupa, Ode-Aye, Ayeka\Igbodigo and Ode-Erinje wards.

    Displaying both the Counterpart Originals and Certified True Copies (CTC) of the documents, Akindele showed the tribunal how 586 was recorded in exhibit I (1) as the number of total votes cast at Unit 18 in Okitipupa II while 58,690 was recorded in Exhibit I (2) of the same unit.

    However, the stamp on Exhibit I (1) was that of the NEC which had ceased to exist since 1993 while Exhibit I(2) had INEC stamp on it.

    The same scenario, according to her, played itself out at Ode-Aye Ward where the counterpart original and the CTC of Exhibit M bore both NEC and INEC stamps as well as Exhibit K in Okitipupa I wards 1 and 2.

    She also told the tribunal that results marked Exhibit M, Unit 002, Exhibit T Ward 002 and Exhibit L1 Unit 004 were all signed by one Akinbo Kehinde as both Peoples Democratic Party (PDP) agent and presiding officer.

Allowing the truth, which is that Mimiko won the April polls hands down is a sure start for proper democratic rule in Ondo State. Your Excellency Dr Olusegun Mimiko, you have persevered and you will get your mandate back. As I always maintain, this wait is God’s grooming way and a sure sign that your vision for Ondo State will be realised for yours is not a case of easy come, easy go.     This forum is created for one thing only- information dissemination on the events during and after the April elections in Ondo state. This forum is solidly for Dr Mimiko, and it’s privately funded and managed independently of the Mimiko/Labour Party Organization by the Mahogany Force. Users are not under any instructions to use this site or comment, but they are free to express their wishes as they deem fit, without of course being rude to others.

    This is a new low of executive insensitivity and immaturity, and if anyone is in doubt, check/search any democratic nation to see if there exist a public forum on a government website the way its been done in Ondo State.

    Another crucial day passes and we move on to the dawn of a new era of truth and justice in Ondo State. We pray as always to our true and living God, our just and benevolent father, who will never allow evil to prevail over good; for the return of our stolen mandate to the rightful owner, Dr Olusegun Mimiko. All lovers of the common people in Ondo State will follow a man with true mission and vision and not die hard criminals who beleive only in warring, threatening, cheating, lying, stealing and “juju”. They stumbled and fell but we are risen and stand upright”. For all we supporters of Dr Olusegun Mimiko, I urge you to please read Psalms 11, 27 and 35 only the Lord God is our sheild and buckler and no evil can come near us.     We expect to `chase out` the Deputy speaker of the House(Ondo State) tomorrow. If this prediction is right from close quarters, then we`ll be on for good but probably Gubernitorial decision may not be out till January 2008.

    Ondo may turn down N5bn loan

    The Ondo State Government has said that it may no longer take any loan from banks to execute its capital projects.

    The Commissioner for Finance and Planning, Chief Tayo Alasoadura, said this at a press conference in Akure on Friday.

    Governor Olusegun Agagu estimated in the 2008 budget that his administration would take N5bn loan from a consortium of banks to carry out its “monumental projects.”

    But the commissioner said that the state might not need the loan any longer due to the reimbursement of N8.08bn it got from the Federal Government in December 2007.

    According to Alasoadura, the reimbursement is the amount over-deducted from the state allocation to fast tract the nation’s exit from the debt it owed the Paris club.

    He also said the state got about N21.56bn as the gross revenue which accrued to the state in the last quarter of 2007.

    The state got N4.441bn in October and N4.081bn accrued to it in November while it got N13.038bn in December.

    The commissioner explained that the N8.08bn reimbursement accounted for the increase in the amount accrued to the state in December.

    The Labour Party in the state has always alleged that the state government is planning to take secret loans from some banks.

    But the governor’s aides denied that Governor Olusegun Agagu was planning to take any loan.
