The Labour Party governorship candidate in Ondo State, Dr. Olusegun Mimiko, who was declared the duly elected governor of the state by the state election tribunal, has also filed a cross-appeal on some of the decisions of the panel at the Court of Appeal.

He filed the appeal barely 24 hours after Governor Olusegun Agagu challenged the verdict of the Justice Garba Nabaruma-led tribunal which removed him from office.

Mimiko’s appeal, signed by his lead counsel, Chief Wole Olanipekun (SAN), was filed by one of his lawyers, Chief Yinka Adeyosoye, at about 5pm on Thursday

He challenged the judgment of the panel on two grounds but also asked the appellate tribunal to uphold the judgment of the lower tribunal, which declared him the winner of the April 14, 2007 governor-ship election.

The LP governorship candidate stated in his appeal that the tribunal erred in law for rejecting his evidence, certified true copies of voter-register issued by the Independent National Electoral Commission for some polling units of Apoi in Ese-Odo Local Government Area of the state.

The lower tribunal had nullified the election results of all the wards in Ese-Odo LG except Apoi 1 Ward 1.

Mimiko also contended that the tribunal erred in law when it rejected in evidence a copy of referral letter from Obafemi Awolowo Teaching Hospotal, Ile-Ife, addressed to the University College Hospital, Ibadan, which was produced and tendered.

Consequently, Mimiko sought the order of the appellate court allowing the appeal and affirm judgment of the tribunal as delivered on July 25.

Adeyosoye, while briefing journalists after filing the notice of appeal said, “We have decided to file these two grounds of notice of appeal while the other grounds have been indicated on the notice to be filed upon receipt of record of proceedings.”

    @Mr Fred, my question now is How Long is this sham recourse to the tribunal of Agagu going to take? I hope the Nigerian government has given a deadline for all these round robin occurences to end? What is happening in Ondo State is tantamount to injustice for Agagu himself knows he did not win at the April 07 polls. Why is he trying to decieve himself and gullible people like him?

    I agree with you Ms Omotalor. Unfortunately no one can really tell how long this may take until the process starts off after which we would be able to say 90days maximum. As it stands right now, the EDO guber appeal is yet to start (I belief this info is still true till date) and the same appeal court covers Ondo State and Delta.

    Thanks Mr Fred, as a human being I find this injustice so annoying and the attempts to frustrate so hand clenching. On the other hand, as a child of God, I find the wait a true test of the faithful. Believing strongly that 1. God’s time is the best; 2. Our Ways are not God’s ways, and our thoughts not His thoughts; 3. Ambition is made of real stern stuff; 4. Our God will never allow evil to overcome good, or darkness to overcome light; 5. HE Governor Mimiko has to wait and work hard for this Mandate for a special reason, which is looking back and remembering how hard fought the battle has been, he will not let any usurper, corrupt, nonentities near his seat of governance; 6. Governor Mimiko is growing and waxing stronger daily faced with his baptism of fire which he will 100% overcome; and last but not the least 7. Agagu, having been given so many chances to repent (for God does not love the death of a sinner but rather wants him to repent and live), but as he refuses to, then his “grave” is dug deeper and deeper (nitori Ida Ahun ni pa ahun, Koto ti Harmani gbe, ni won sin si).

    When people think they are the only wise ones, and that their gift of the garb can fool others, God will confound their so called evil wisdom and they end up the most foolish of all (Ahitophel could attest to this if he were alive).

    So we are looking at possibly another 3-4months. What’s this compared to where we are coming from? The only people being short changed here are my people in Ondo State who are unequally yoked together under the governance of the task master – Pharaoh Agagu who still continues to treat Ondo State as his personal property. My people should wake up to the reality of the situation and not allow a few Naira here and there (which is unsustainable anyway) to befudge their minds and cloud their judgements.

    In God will trust. No weapon fashioned against us shall prosper, and NO SHAKKKKIIIIING.

    IROKO YI JOOOOOOO SA MA GBA SIBEEEEEEEEE.

    Hope the security round our Iroko is tight for when I heard about the plot to kill Obama in the US of A, my mind went to Dr Mimiko. God will spare him and he will outlive ALL his enemies in Jesus name.

    The sort of money allocated to build new stadium, in my opinion, could have been better used for making the roads (in terrible state all over) safer/motor-able rather than a `white elephant ` project that will only feed the pocket of the few at the end of the day with nothing to show for it. Anyhow, who says there is any brain with these fellers?!!!!

    Agagu begins N3.7bn stadium project

    ONDO State governor, Dr. Olusegun Agagu has flagged off a N3.7 billion ultra modern Olympic seize stadium in Akure, the Ondo state capital.

    The governor who performed the ceremony assured the people of the state that the project would be completed by April, 2010.

    The contractor, CCC Construction Nigeria Limited ,Dr. Agagu stated, was selected from among lots of 17 other contractors who expressed interest in the project, adding that government was hopeful that the eventual winner would live up to its internationally recognised reputation in the handling of the project.

    “The contract for this project was awarded in line with our usual practice; the contractor will be paid substantial part of the contract sum as mobilisation, the cheque of which will be handed over to the management in the course of this programme.

    “Let me however remind the contractor that to whom much is given, much is expected,

    hence CCC Construction Nigeria Limited should leave no stone unturned in its efforts to deliver this project within 80 weeks as promised which counting from this moment and will become due by April, 2010”, he said. The main bowl of the stadium when completed, he said, would occupy a 10,000 capacity sitting terrace, Other ancillary provisions, he explained, include car park, training pitch, shopping arena, medical centre, press gallery and an ICT centre for easy communication. The project would also have tartan tracks of 10 lanes, flood lights, electronic score board, a befitting state box (including VIP extensions) modern office accommodation and a host of ancillary facilities. Efforts to develop the state, Agagu noted, that his administration had laid the ground work for sustainable development of the state assuring that nothing would deter them in their march to take the state to the next level, through the execution of people-oriented development

    programmes.

    Tribunal upholds Segun Oni election in Ekiti. In a way, this is good News for Ondo State. Yes I know this is a `stong` statement but with permutation, this will have a positive effect at the the appeal court pending (take it not at the face value).

    @Mr Fred, do you blame Agagu for still as usual spending Ondo State Allocation nilly willy. I dont. What is missing in the laws is a clause that would ban any outsted governor who is awaiting appeal from undertaking big projects that could easily waste, dwindle or gulp down the State funds, even into personal pockets. If this was in place the coffers of the state and indeed the people would be spared horrendous wastage. Its a crying shame that we just have to watch on as Agagu and his croonies keep on slapping Ondo State in the face. I feel so sick I force myself not to throw up when I hear all these repeated empty promises of unsustained, phantom and white elephant projects in Ondo State. Morning shows the day. Time will tell.

    As for the appeal court, we have no doubt that the verdict given by Nabaruma will be upheld. Why? Ondo State election rigging and malpractices were so gross and vast that the whole world actually gave an uproar and decried it very seriously. Well, I never thought I would say this but thank God OBJ went over the top(OTT) when he ordered Agagu should be declared winner via Abuja, even while the INEC oga at Ondo State was still trying to unravel the election sham. So who now will start believing Agagu and his PDP touts?

    Mr Fred, let’s not be too self-centred here. A monstrous injustice was committed against the people of Ondo state when our mandate was shamelessly hijacked by the PDP. Thankfully, the tribunal has reversed this injustice, albeit with the court of appeal to make the final decision. With regard to Ekiti state, evidence actually suggest that what the PDP did ensure the imcumbent governor remained in place in our state – subterfuge, shenanigans, underhand tactics etc, were also replicated in Ekiti state. We therefore should be mourning with our Ekiti state counterparts because evil seems to have prevailed over good; of course the AC candidate has the option of appealing against the shameful decision returned by the Ekiti state tribunal.
    So Mr Fred the decision in Ekiti cannot be deemed to have been good. In fact to all lovers of true democracy, and that includes those of us in support of Dr Mimiko and the Labour party in Ondo state, this is indeed an unfortunate occurrence.
    We (i.e supporters of justice in Ondo state) must therefore not tarnish the success attained so far by coming forth with statement that appear to be myopic.

    Agree with you T.A. but remember, do not take my statement at the face value. I know Fayemi very well and I Know Segun also( I have close common friends with both of them). The statement did not diminish the injustice in Ekiti but again, T.A. you must read more to my statement. I will comment no more on this issue.

    Chairman of the Independent National Electoral Commission (INEC), Professor Maurice Iwu, on Thursday said that the Peoples Democratic Party (PDP); former President Chief Olusegun Obasanjo and his deputy, Alhaji Atiku Abubakar, jointly contributed to any lapses detected in the 2007 election.

    He also said that some foreign observers approached the commission with a bribe of 40 million euro to destabilise the process of the election.

    Prof. Iwu, at a public lecture organised by the Political Science Department of the University of Nigeria, Nsukka, Enugu State, said “the crisis in the Presidency which saw the exit of the Vice President Abubakar from the government and the PDP presented additional burden in the management of the elections.”

    “justice will be served one day….” This will be a reality even in a country like Nigeria for there will be a complete turn around of injustice some day soon. But for now, LET JUSTICE BE SERVED IN ONDO STATE. Mimiko won the April Polls, beat Agagu hands down and is patiently following the path of justice and this will not elude him. Yes there could be machinations at play but in Ondo State the truth is all so glaring, and we need this monstrousity called injustice to be eradicated, starting with Agagu.

    AT least 18 local government chairmen in Ondo State are to be grilled on Wednesday by operatives of the Independent Corrupt Practices and Other Related Offences Commission.

    The commission has already sent letters of invitation to the chairmen for questioning over alleged diversion of N12.5bn from the state‘s federal statutory allocations.

    Specifically, ICPC investigators want them to explain all they know about the bank interests that accrued on the N12.5bn.

    A source at ICPC told our correspondent that several career officers and three commissioners in the state administration had been quizzed by ICPC investigators in Abuja last Tuesday.

    “The council chairmen have been told to bring various documents along with them. The major focus of investigations is unravelling what became of the bank interests that accrued on the N12.5bn; how it was disbursed and who the beneficiaries are,” the source stated.

    Some of the state government officials, who came for interrogation had been released on bail.

    But they are expected to return to ICPC headquarters on Wednesday next week.

    “ICPC’s investigators are almost through with their job. They are in the process of compiling reports that will be used to decide the final action to be taken on the matter,” the source added.

    When contacted on the telephone on Saturday, ICPC‘s Resident Media Consultant, Mr. Folu Olamiti, stated that investigations were in progress on the matter.

    We hope the court of appeal will start sitting by mid-september but whether there will be two simultaneous panels, one for Ondo State and another for Edo State is not clear. If it`s going to be only one panel, then I guess, we`ll have to wait till Oshiomole case is concluded.

    One thing is certain, we will continue this struggles and especially with prayers. We are asking for nothing but the revelation of the truth and the installation of the people’s choice. Our Lord Jehovah who has brought us this far will not desert us for He does not support evil, lies and treachery. Whichever way the Court of Appeal decides (panel wise), there will be a joyful end to this saga, sooner than later. The Ondo State governorship heluva palava (for Agagu), is of interest to so many countries worldwide and the interest is not wanning. Mimiko all over the world is likened to Obama in resilience, Godly favour and Intent. We are winners and no one should feel weary or faint about this. Peace
