Indictment: Agagu Loses Bid to Stop Probe. ThisDay
A Federal High Court in Abuja yesterday assumed jurisdiction in a suit seeking to void the clearance of Ondo governor, Dr. Olusegun Agagu, to contest the April 14 gubernatorial election.
Justice Abimbola Ogie dismissed an objection filed by Agagu’s counsel, Chief Adetokunbo Kayode (SAN), challenging the court jurisdiction to entertain the suit.Ogie held that the case, though a pre-election matter, had not been overtaken by events and that the relief being sought by the plaintiffs was not for the exclusive determination of the Election Petitions Tribunal.
She also dismissed the objection that the governor was covered by Section 308 of the 1999 Constitution (Immunity Clause) from any civil and criminal cases while in office. Ogie said that Agagu could not be protected by the immunity clause from being investigated over an allegation that he had been indicted by an Administrative Panel of Enquiry and was, therefore, not qualified to participate in the polls. She ordered the counsel to the contending parties to file their briefs of argument on the substantive case and adjourned till May 17 for the adoption of the briefs by the lawyers.
In a swift reaction, Kayode today filed an appeal against the court decision before the Court of Appeal in Abuja. In the appeal, he contended that the judge erred in law when she held that the suit was not a post-election matter for the exclusive determination of the Election Petitions Tribunal.

Our God is a just God. He will not permit His children to be trampled and disgraced. He metes out justice and judges righteously. Nigeria has sound minded members of the judiciary who are God filled and who would stand for the truth come what may, and this is our delight. Justice Abimbola Ogie has ruled judiciously. There is no immunity anywhere for wrongdeeds, corruption, embezzlement and pillage. Kayode can refer the case to Abuja, to anywhere else. From now on God is the controller of this show and will speak justice and truth through all the law courts. This coupled with the appeal from MIMIKO re our stolen mandate via daylight robbery would give the desired result that Ondo state and all God fearing people of Nigeria have prayed so earnestly for.
On a different note is it true that OBJ has approved the gross sum of N32 billion naira for the innauguration of Yaradua? He ruled Nigeria for two terms (8 years) and could not even stabilise NEPA or electricity or provide pipe born water to all yet he has 32 billion to lavish while Nigerians are suffering en masse!!! This is a warning for us in Ondo state. Agagu worships the ground that Obasanjo walks on, OBJ is his mentor and role model. Is this the legacy of abuse, punishment and disgrace that we also him to leave us in Ondo state. God forbid. This is why Ondo state is saying no to a MANDATE THIEF AND A DESTROYER OF GOOD THINGS.
Lord God, remember these things and do not let the wicked go unpunished. As for your son OLUSEGUN MIMIKO whom you have chosen to do your divine will, please be with him at all times and never leave him desolate. This is your promise to Joshua, to us in Ondo State and to IROKO. WE LOVE YOU GOD.
If you win this battle Mimiko, we expect you to deliver! Ondo State has been one of the most unfortunate in Nigeria with regards to poor leaders.
Agagu just joins a long list of past failed governors. Why have we never produced a Donald Duke in Ondo State?

IF THE STATEMENT MADE BY MR. ADEKUNBI A. TAYLOR WAS TRUE, THIS MIGHT FINALLY BE THE DEMISE OF OBASANJO. I AM SURE THAT ALL NIGERIANS ARE NOW SURE WHY OBASANJO WANTED TO INSTALL YAR ADUA AT ALL COST.
UNDER NO CIRCUMSTANCE MUST GOVERNMENT GO INTO BANKRUPTCY IN ORDER TO INSTALL ANOTHER HELL OF STATE. IF THIS EVER HAPPENS, OBASANJO MUST BE ARRESTED, TRIED AND JAILED FOR STEALING FROM THE NATION. THIS TIME HE MUST PERISH IN JAIL. SWEAR-IN-CEREMONY IN A COUNTRY LIKE OURS SHOULD NOT COST GOVERNMENT MORE THAN #2-3 BILLION; GIVE AND TAKE.
I did read this in one of the Nigerian newspapers on the net and this is not idle gossip told me by someone. If you are angry about the 32billion naira go ahead, please wait until you read the breakdown. 60 vehicles purchased to ferry guests at 7billion, 3 top hotels booked at 7 or 5 billion? waiters and ushers – 5 billion etc etc. I almost had a heart attack! Wow, Nigeria why do we have to suffer so much. It is a real pity a real shame. God will judge, the sword of Damocles will clear the evil in our midst. I weep for Nigeria. I fear for Ondo state and the result of having the likes of Agagu continue especially when they fraudulently take what is not theirs including the MANDATE OF MIMIKO THE TRULY ELECTED GOVERNOR OF ONDO STATE. Charlesco sir, you touch the very cord of some of my thinkings. As much as I as an Evangelist of the Lord would decry bloodshed and revolutions etc, it does take the grace of God in me not to agree that this is the path that Nigerians would need to go for redemption and total change of this atmosphere of corruption, looting, squandering, intimidation and murder to mention a few. I knew Ghana of those days i.e. the 1970s as I have family ties with Ghana and I know the Ghana of now where the so called renowned of Nigeria resort to buying villas, sending their children to school etc. It did take Charles Taylor to bring about the change with the total wipeout of all old school thiefs etc etc. I very much believe and this is my hope and prayer daily that WHEN MIMIKO ASSUMES OFFICE IN ONDO STATE, HE WILL DELIVER A KIND OF GOVERNORSHIP AND ADMINISTRATION THAT WOULD BE THE ENVY OF OTHER STATES IN NIGERIA. THEN THESE OTHER STATES WOULD EMULATE ONDO STATE WHEN THEY SEE A GOVERNOR WORKING SO HARD FOR THE PEOPLE AND CHANGING THINGS AROUND SO MUCH THAT THESE OTHERS WHO MAY HAVE ASSUMED OFFICE TO ALSO LOOT WOULD BE TOUCHED AND START DOING THE RIGHT THING. Shagari did not do 1/4 of what he’s done but see the afflictions that Shagari went through. Our God lives and reigns. He is slow to anger but he is a just good and metes out justice and judgement. Yes we all need to continue to pray for peace in Nigeria. Reading today about the militant style bombing of Jonathan Goodlucks residence, maybe one of his many properties, I really fear fro Nigeria. People are ready to go into serious action to make their dissaproval of the state of Nigeria known. Please my people of Ondo state let us not yet resolve to force for God is in control and will make things happen for us for I know that MIMIKO’s STOLEN MANDATE WILL BE GIVEN BACK TO HIM. We have been patient in faith and trust in God and this is the right recipe for success. One thing is clear and I believe the Electoral Tribunal will take coignisance of this, Nigerians are ready to fight for their rights and will not take injustice lying down.
