Agagu plans large scale violence at Tribunal venue, releases N25m, LP alleges …distributes LP’s vests and caps to thugs

With apparent defeat staring him in the face going by the spate of the unfavourable rulings against him at the Election Petition Tribunal, the Ondo State governor, Dr Olusegun Agagu has released the sum of N25million to carry to embarked on a large-scale violence around the venue of the Tribunal which is sitting in Akure using hired thugs dressed in vests and caps of the Labour Party (LP), the Ondo State Labour Party has alleged.

Also, leaders of the LP in the State are to be attacked by these hired thugs in a renewed assault meant to cow the party leadership as from this week.

LP, in a release issued by its Director of Press, Mr.

Kolawole Olabisi, disclosed that a this desperate act by a highly worried Agagu, which also include possible attack on the persons of the 5-man Justice G.M Nabaruma Tribunal members was meant to intimidate the members and possible stampede them into shifting the venue of their sittings from Ondo State.

Dr. Agagu had penultimate week had about 70% of his response to the Petition of LP’s Candidate, Dr Olusegun Mimiko challenging his supposed victory at the April 14 gubernatorial election in the State struck out by the Tribunal. On Wednesday last week, he suffered another setback when the Tribunal refused to vacate its earlier Order allowing Mimiko to carry out electronic scanning of electoral materials used for the contentious election.

According to LP, Agagu who had to hurriedly round off the State Executive Council meeting last Wednesday when news got to him that the Tribunal has asked Mimiko to continue with the scanning of the ballot papers used for his controversial victory, hurriedly left for Abuja. From Abuja he went to Lagos where he presided over a meeting in Ikoyi where it was agreed that Mimiko’s winning steaks must be curtailed at all cost.

    Please accept my appology all of you communicating through this medium. My appology in the sense that, I informed you last month that by the Grace of God that the `rogue` will pack his bags and leave Ondo State(not exactly the line I used), however, it appears as if this will not happen till September 2007(next month), major sitting and aguement starts in the Tribunal Tomorrow and the evidence remain convincing of the other side`s (PDP) lies and manipulations. Please remain committed and do not be discouraged for this minor delay in the judgement day , for together we shall all celebrate. On the day of inauguration of the duely elected Governor, I shall certainly travel to Nigeria and make sure and give all of you a warm hand-shake.

    MY PEOPLE, If you all can take time out to read just the 10 chapters of the book of Esther, you will find the tale of 2 people unfolds again – Haman Agagu vs Mordecai Mimiko. Haman plotted against the Jews and Mordecai for Mordecai refused to bow to Haman. Haman found favour in wickedness with King Ahasereus OBJ, was promoted while Mordecai lamented. But when God is in control, evil will fail and the sons of Lucifer would be annihilated. Haman plotted more, to kill Mordecai, and honour himself. But all glory be to God, for Haman was INDICTED, HANGED AND BURIED IN THE PIT HE PLANNED FOR MORDECAI! Mordecai was given Haman’s house and I quote from Esther 8:15-17

    ” 15 Mordecai left the king’s presence wearing royal garments of blue and white, a large crown of gold and a purple robe of fine linen. And the city of Susa held a joyous celebration. 16 For the Jews it was a time of happiness and joy, gladness and honor. 17 In every province and in every city, wherever the edict of the king went, there was joy and gladness among the Jews, with feasting and celebrating. And many people of other nationalities became Jews because fear of the Jews had seized them”.

    MIMIKO is our Mordecai who will yet wear the crown of Gold while Ondo State and lovers of truth and justice will rejoice. THIS IS THE WORD OF GOD, PRONOUNCED AND RATIFIED.

    All that Agagu tries to do to subvert the course of justice will BOOMERANG IN JESUS NAME. He will fail woefully in his quest to cause further confusion and chaos in Ondo State and in the whole of Nigeria and all over the four corners of the world. Those he hires to kill will turn on him and his followers, they will sing then singe. Just as the fame of Mordecai was pronounced in Esther 10, so shall the fame of Mimiko as Governor of Ondo State and all his good works be declared all over the world.

    September indeed it had always been as declared by God, who will never fail. When Jesus says Yes, nobody can say no. My people, reamin calm and happy and rejoice for the joy of the Lord is our strength in Ondo State and we are all overcomers. Nothing will touch or harm Mimiko and his followers.     Legal row in Ondo Tribunal over Agagu’s submissions

    CONTROVERSY and confusion yesterday trailed the submission of the reply of Ondo State Governor, Dr. Olusegun Agagu to the petition filed by the Action Congress (AC) seeking the nullification of the April 14 governorship election in the state.

    At the sitting of the tribunal in Akure, there were accusations and counter-accusations between the counsels of AC, Dr. Tunji Ababyomi and that of the Peoples Democratic Party (PDP), Chief Kayode Olatoke in one hand, and between the PDP counsel and the Secretary of the Tribunal, Mrs. Rasheedat Rasheed on the other hand.

    The date of the submission of Agagu’s reply was the basis of the argument as it was clearly written 2nd July against 29th May, 2007 which he supposedly relied on.

    Agagu’s counsel, Olatoke however, blamed the secretary of the tribunal for the mix- up saying

    that they did not file their rely on July 2 but

    rather on May 29, 2007.

    In a counter-affidavit, Rasheeedat stated that Agagu actually submitted the reply on July 2 and not on May 29. She said that the governor’s claim was an embarrassment to her.

    In his own argument, the AC counsel, said there was no doubt that the respondent (Agagu) wanted the lady to land in jail because there was confusion on the date which the reply was submitted.

    Stating that one of them must be saying the truth Abayomi noted that the counter affidavit of the PDP was full of controversy and confusion.

    “The reply was filed out of time without the courtesy

    of applying for extension of time. If you look at the reply itself, it has raised many doubts of the integrity on the governor. Even page 566 on the reply of which one Femi Agagu deposed to, the signature on it indicated 2nd July and even that of governor Agagu himself, on pages 842 to 846 indicated 2nd July 2007. Then how come they submitted the reply on May 29th?” he asked.

    Abayomi therefore asked the tribunal to grant his prayers by striking out the reply of the governor because the reply to their petition was late.

    But Olatoke said that the error was a human error, which was pardonable in the court, saying that the intention was not to mislead the tribunal as AC counsel was trying to say. He added that they

    were not blaming the error on anybody.

    He said that Abaomi can only pray the tribunal to set aside the reply and not to strike it out completely.

    “My lords, all these happened due to human error and nobody should be blamed for it. And I urge your lordship to strike out the application,” he added.

    The Justice G.M Nabaruma-led tribunal

    adjourned ruling on the application of the AC to September 11, 2007.

    Meanwhile, the tribunal has been urged to recommend the arrest of a PDP chieftain and former Speaker of the Ondo House of Assembly, Victor Olabintan for multiple registrations.

    Olabintan, whose attempt to come back to the Assembly was stalled by his defeat at the polls by the Alliance for Democracy (AD) candidate, Abiodun Ogunbi, in his Akoko South West constituency, was alleged to have registered twice during the voters’ registration exercise that preceded the April polls.

    Abayomi, counsel to the AD and Ogunbi told the tribunal at the resumed hearing of the matter at the weekend, that by registering at two venues, the former speaker had committed an offence clearly stated in the 2006 Electoral Act.

    Describing the petitioner as somebody who has no regard for the electoral process “as shown by this

    illegal action,” Abayomi requested the tribunal to direct INEC to order the arrest of Olabintan to serve “as a deterrent to those who are still holding the law of the land in utmost contempt.”

    While moving the motion for the order to arrest Olabimtan, Abayomi said multiple registration is an offence punishable under section 124 of the Electoral Act stressing, “any person who does any act whereby he is by whatever name included in the voters’ register for a constituency in which he is not entitled to be registered or place, commits an offence punishable under the law.”

    The counsel disclosed that during a research, he discovered a shocking material showing evidence that the former speaker registered in at least two places “with the intent to confer undue advantage to himself and his party.”

    He said he discovered that the former speaker registered as Adekanye Olabimtan at unit 6 Supare 1 with registration number 30501200054 and as Victor Olabimtan at Akungba II with registration number 30501201405.

    He said apart from multiple registration, the former speaker also gave false information about his identity which is equally punishable under the law.He said that under section 57 of the Electoral Act, the tribunal was duty-bound to recommend to INEC the prosecution of any person for any offence disclosed.

    Abayomi claimed that “Olabimtan being a criminal cannot bring a petition because he who comes to equity must come with clean hands.”

    However, when the Justice Nabaruma asked Olabintan and PDP’s counsel, Olatoke to comment on the motion, the lawyer said he needed time to file his reply because he was hearing the allegation for the first time.

    The tribunal adjourned the case till Wednesday August 23 for further hearing.

    Ondo dep speaker found with charms at tribunal
    Yinka Oladoyinbo Akure – 24.08.2007

    SECURITY was beefed up on Thursday at the Akure, Ondo State High Court premises, venue of the sitting of the state election petition tribunal following the discovery of objects and substances suspected to be charms in the official car of the deputy speaker of the state House of Assembly, Mr. Mayowa Akinfolarin.

    Barely two hours after the incident, a middle aged-man, who identified himself as Omo Benson, was also caught by security agents with charms.

    The incidents led to a mild drama in the Court Two venue of the sitting, as security agents asked those already seated to go out before they were later frisked with metal detector and allowed in again.

    The car, a Toyota Avensis, was said to have been driven into the court premises at about 8.20 a.m. with the number plate covered with a black leather.

    The development, according to eyewitnesses, was said to have raised the curiosity of the policemen attached to the court, following which a search of the car was conducted.

    However, after some arguments between the deputy speaker and the policemen, it was gathered that the security operatives insisted on searching the car thoroughly.

    A medium-size black pot was discovered stuffed with different substances suspected to be charms after the search. Upon this discovery, the security agents searched Akinfolarin and also found some more.

    Nigerian Tribune gathered that the policemen then ordered the deputy speaker to carry the pot out from the booth of his car with his hands.

    The policemen were said to have ordered the deputy speaker out of the court premises and told him not to come near the tribunal sitting again.

    Attempts to reach the deputy speaker were futile as one of his aides, who picked the calls put through to his line, said he was in a meeting.

    The second incident happened at about 9:19 a.m. when objects also suspected to be charms were found on Benson.

    The charms, two gourds plastered with animal skin and cowries, were discovered inside the pocket of the knickers worn by the man, who claimed to have come from Okitipupa Local Government Area.

    The man, who claimed that he was in the tribunal to support the Peoples Democratic Party (PDP), said he was mobilised by a party leader.

    Speaking with newsmen, Benson said “ I came from Okitipupa to support the PDP. A PDP man chartered a bus for us.” Following the development, many people were prevented from entering the court as more armed security men were later deployed there.

    I feel ashamed that this fellow is a member of my state legislature. This is 2007 for heaven’s sake, not year 20BC.
    At least what everyone has always known to be a fact is beginning to unravel. This is a prima-facie evidence that the PDP who thwarted the wishes of the electorates in April have no case. The labour party candidate won the gubernatorial election hands down. When the idiotic thieves who stole our mandate could not appeal to reason and hard evidence to maintain their hold on power, they are now resorting to Ayelala and other esoteric means.
    This indeed should be a pointer to the tribunal that the PDP indeed did falsify the election results to their advantage and then go on to install the rightful winner of the election at Oke Eda.

    I know without being told that it is all going on well for God has decreed that in this Ondo State Petition, He will not let the Just man suffer. MIMIKO will get back his stolen mandate, and this is a fact.

    Now read this post on Vanguard yesterday. What is new, i.e. with Agagu always denying things. What exactly has he ever owned uo to? If it is true that the allegations are false and the people are phantoms, what stop their arrest for false accusation of a fake governor with fake governorship immunity? Agagu should really show the people of Ondo state in practice what he has done and not done and not just use his pressman to make statements to justify or hide him all the time. As for concentrating on developing Ondo state, how far 41/4 years on? When Agagu/Ondo state PDP resorted to Politics of “do or die”, they never thought it would boomerang on them did they?     Agagu denies procurement of arms for April polls

    AKURE—GOVERNOR Olusegun Agagu of Ondo State has raised alarm over a grand design by some people to malign him over retrieval of arms allegedly procured for them by him for the last general election in the state.

    A statement by the governor’s Chief Press Secretary, Mr Yemi Olowolabi in Akure advised members of the public to ignore such allegation as the governor did not need the force of arms to be re-elected.

    Dr Agagu pointed out that recently, a group known as MEND purportedly alleged that some leaders of the party entered into an agreement with them towards the last election and demanded for N500m to dispatch some stranded youths who were hired to ensure his re-election.

    “The position of the government was to ignore such publication and concentrate on its dexterous developmental efforts having earned the confidence of the people of Ondo State for another term in office.

    “However, having failed to achieve the desired attention from government in the first instance, those behind the ill motivated act has moved to yet another state in their voyage of mischief.
    “By this, some group of persons claiming to be MEND are to call on Governor Agagu to retrieve from them arms allegedly procured for them by His Excellency for the last election.

    “It is imperative to reiterate that Dr Agagu did not need the force of arms neither did he require the services of MEND to be re-elected as governor”, he said.

    YOUR FAKE USE OF BIG ENGLISH WILL NOT SAVE THE DAY MR YEMI OLOWOLABI. Why would these people MEND be pointing fingers at Agagu? At least the saying goes that there is no smoke without fire.

    “We believe that the judiciary is very important and we are making sure it is reformed to carry out the assignment effectively.
    “The other aspect we are looking at is investigation. We want to ensure that no matter what time it takes, every crime must be investigated and the perpetrators made to face the law. If we do not do this, we will go back to the time when people commit crime with impunity.

    “The moment people know that no matter what time it takes any crime committed would be unveiled and those involved punished, it would help us a lot.”

    MY QUESTION IS, HOW SOON WILL AGAGU’S AVIATION CRIME BE DECIDED?

    FORMER President Olusegun Obasanjo has said that he could not be questioned over the conduct of the April 21 presidential election because he had immunity when he supervised the exercise.

    The entire general election had been scored low by both local and international observers. His claim was contained in a motion on notice filed at the Presidential Election Petitions Tribunal sitting in Abuja, by his counsel, Mohammed Bello Adoke (SAN), in reaction to his joining as a party by General Muhammadu Buhari in his petition challenging the election of President Umaru Yar’Adua.

    Buhari, who was the presidential candidate of the All Nigeria Peoples Party (ANPP) in the election, alleged at the tribunal that Chief Obasanjo gave undue advantage to President Yar’Adua, who was the standard-bearer of the Peoples Democratic Party (PDP) in the election.

    Based on his conviction that he could not be queried over his handling of the exercise, Obasanjo, who is also of the PDP, is asking the tribunal to strike out his name from Buhari’s petition, “having been improperly joined in breach of the provisions of the Electoral Act, 2006.”

    He also stated that he had the advantage of presumption of regularity of all his actions while in office, including the handling of the elections.

    In the seven grounds upon which he premised his request, he claimed that; “the third respondent/applicant (Obasanjo), the sitting president of the Federal Republic of Nigeria at the time of the election, is not one of those persons who can be made a party to an election petition.

    “He is neither a necessary nor a proper party in this petition, in accordance with Section 144 (2) of the electoral Act, 2006. “He never acted as an official of the Independent National Electoral Commission (INEC) in the election held on the 21st of April, 2007 and did not take part in the conduct or management of the said election.

    “The acts and omissions for which the third respondent (Obasanjo) has been joined as a party in this petition took place before, during or immediately preceding the said election on the 21st of April, 2007, while he was still in office as the President of the Federal Republic of Nigeria.

    “The joinder of the third respondent (Obasanjo) as a party in this petition was effected in clear breach of the provisions of Section 308 {1}{a}of the Constitution of the Federal Republic of Nigeria, 1999.

    “The joinder of the third respondent/applicant as a party in this petition has no legal basis and was done malafide and to irritate the applicant {Obasanjo}and, to that extent, constitutes a gross abuse of court process.

    “There is a presumption or regularity of all the actions and policy decisions made by the third respondent/applicant while in office.” In a five-paragraph affidavit in support of the motion deposed to by Ifeanyichukwu Ugwu-Anichi, it was claimed that all Obasanjo’s “actions and polices while in office were for the good of the country and not for a political party, tribe or religion.”

He is only trying to impress and catch up in fear, for Ondo State knows the truth that for four years Agagu didnt do much for the state and now is pretending, hoping he can fool his way out of trouble.     Agagu trudges on in spite of litigations

    UNLIKE what the situation was in Ondo State in the same period during Dr. Olusegun Agagu’s first term in 2003, the first 100 days of his second term is being marked with a plethora of contentious issues thrown up by the fact that the state is no longer in the firm grip of the Peoples Democratic Party (PDP).

    The state government has tried to take off with the composition of a 230-member committee to review its earlier development plan tagged ‘Road Map to Progress’ put together in 2003. The composition of the committee has been vehemently condemned by the opposition Labour Party (LP) which described it as an attempt by the government to cover up what it called “obvious lack of focus and preparedness to govern the state.”

    Despite the opposition, however, government has, in the last 100 days, recorded some landmark achievement with the flagging off of the N6 billion Adagbakuja reclamation project, designed to create a homeland for the coastal Ilaje communities, the release of N1.2 billion to shore up the water provision efforts and provision of over a billion naira for the construction and rehabilitation of primary school buildings in the state.

    The state Commissioner for Information and Orientation, Eddy Olafeso, said the fresh fiscal releases would increase water provision to about fifty per cent of the state population from the abysmal 4.4 per cent that the Agagu government met on ground in 2003 while 100 primary school buildings would be constructed to increase the number of such buildings to over 300.

    The governor has extended an olive branch to the opposition to participate in his administration. It was only this week, he appointed some of his co-contestants into some of the state agencies.

    Understandably, the LP, which is claiming that it was rigged out in the polls, and which has great optimism that the Election Petition Tribunal would upturn the victory in its favour, is said to have rejected the move.

    But the Agagu peace initiative, even though it embraced the six political parties that accounted for less the eight per cent of the votes cast in the last polls, has been hailed as an example of magnanimity in victory which is lacking among Nigerian politicians. Perhaps the most contentious issue in the Ondo polity is that of security where the two political gladiators are always making claims and counter-claims.

    The Chief Security Officer (CSO) to the governor, Mr. Tunde Awanebi, gunned down by yet unknown two-man gang on motorbike one evening at an Akure supermarket, was one of the notable figures cut down in the state of insecurity Ondo State has found itself. One of the immediate reaction of the governor to this wave of insecurity was the ban on motorcycle movements from dusk to dawn.

    The accusations on security issues have also dominated the proceedings at the Election Petition Tribunal with accusations and counter-accusations coming from counsels to the two political parties. At one instance, proceedings were suspended when the LP legal team requested that they be given the chance to travel to Abuja to formally lodge the reports of threats to their lives by unknown persons.

    And for three hours when they came back, proceedings were also stalled when they brought a damaged vehicle, which they claimed was smashed in an encounter with a team of hired assassins on the road from Abuja. However, the main issue in the state today, which has formed the agenda at every gathering is the outcome of the on-going litigation over the disputed April 14 gubernatorial election.

    The governor, who presided over the meeting, while reacting to reports in a section of the media that he had been flown abroad as a result of injuries he sustained, described rumour mongering as a destructive fire, that is not in the interest of the country and the people.     He said he decided to seek treatment at the newly equiped State Government Hospital instead of wasting the public money on seeking treament abroad.     The governor said he was suprised that rather than receiving praises from the people for seeking treatment in a government hospital, the people went to town with exagerated version of his injury. “I am a man who wants the system to work. If the state hospital was still in the same state it was years ago, they wouldnt have been able to treat me. If i didnt believe in Nigeria, i wouldn’t have allowed them to treat me at Igbobi. But rather than celebrate a man who believes in the system, they went to town with rumour that I had been flown abroad. This type of thing is not good for our nation and the people.     Governor Agagu went on to implore Nigerians to cultivate the habit of celebrating positive stories about their leaders, which he described as tonic needed by good leaders to do more for the people and transform the nation.     Ondo PDP, LP trade charges over illegal bunkering

    THE Ondo State chapters of the Peoples Democratic Party (PDP) and Labour Party (LP) are trading accusations over illegal bunkering activities in the state.

    The PDP has alleged that the opposition LP should be held responsible for the high spate of illegal oil bunkering in the oil-producing creeks of the state.

    A statement yesterday by Donald Ojogo, Press Secretary to the state Governor, Olusegun Agagu, said: “Government finds it unbelievable that prominent members of the Labour Party in the state are the brains behind the menace of illegal bunkering, which has adversely affected the economy of the nation.”

    But in a swift reaction, the LP spokesman, Kolawole Olabisi, said the government’s allegation was “a figment of their imagination as they are only trying to cause confusion by diverting attention from their associations with the outlaws of the creeks”

    Olabisi stated: “Everybody knows the party that used the militants to subvert the will of the electorate in the last elections as manifested by the kidnappings of PDP chieftains who reneged on their pledge to settle them monetarily”.

    Alleging the LP’s culpability in illegal oil activities, the government said: “Precisely in July last year when it was resolved that the activities of these bunkerers be stopped in the creeks of the state, leaders of the LP from the south senatorial district of the state held a meeting with the bunkering cartel in a hotel at Ore, promising to allow them to return to the creeks to continue with their illegal business once they supported the party financially.

    “They had hinged their promise on the dream that their governorship candidate was to be declared winner of the April election in August last year. A series of follow-up meetings were held by both groups at various locations until the bunkering cartel finally agreed to back the LP financially to pursue its case at the election petition tribunal.

    “They thereafter, engaged in blackmail of the state government as well as high-ranking officials of the state who played prominent roles in stopping the menace of illegal bunkering. The harassment of some of these officials underscores this position.”

    While the LP challenged the government to name opposition members found to be aiding bunkering, the PDP said: “Without prejudice to on-going investigations by the security agencies, it is unfortunate to note that three of those arrested for illegal bunkering activities are members of the Labour Party.

    “They are a councillorship aspirant, an official of the party in one of the riverine councils as well as the younger brother of a state assembly aspirant of the LP. Attempts by some lawyers in LP’s legal team to secure the release of their party men confirm this position.”

    But Olabisi said: “An indisputable fact is that the PDP is in control of those bad boys of the creeks and it is those boys that are in control of the illegal activities. We call on the security agencies to carry out a detailed investigation to know who is lying.”

    Kogi Gov. Sacked, Ordered To Hand Over To Speaker

    The Court of Appeal sitting in Abuja this morning upheld the judgment of the Kogi State election petition tribunal which had earlier on nullified the election of Abubakar Idris as the governor of the state. In a unanimous decision read by Justice Victor Omage, the court affirmed the ruling of the tribunal and ordered that a fresh election be conducted according to the stipulated period as contained in the Electoral Act 2006.

    The Court of Appeal also blasted INEC for usurping the powers of the court when it unlawfully excluded Prince Abubakar Audu from contesting the election based on section 182 (1) of section 1 of the 1999 constitution.

    The court questions INEC’s power to interpret the same section and held that only the courts have the power to disqualify any candidates as have been upheld by the Supreme Court in AC vs INEC.

    According to the presiding judge, “Only the courts can interpret section 182(1). I hereby resolve the issue in favour of the appellant.”

    The court also gave INEC knocks over the manner it implemented the report of the panel which indicted Prince Abubakar Audu and averred that INEC is a non-judicial body and lacks the power to implement the recommendation of the panel in the way and manner it did.

    INEC had earlier on challenged the judgement of the tribunal on the ground that it favours Abubakar Audu who was the right party before the tribunal since he did not contest the election.

    On this issue, the court relied on section 145(e) of the Electoral Act 2006 and held that indeed Abubakar Audu was properly nominated by his party, the All Nigeria Peoples Party, and that the party was right in challenging the unlawful exclusion of its candidate. It thereby upheld the decision of the tribunal and determined the issue against INEC.

    There was wild jubilation as Audu’s supporters took over the premises of the court singing and dancing to celebrate their judicial victory over the incumbent governor of the state.

    On the other hand, supporters of Idris turned aggressive and were seen attacking vehicles as they made their way out of the court premises.

    It took the intervention of mobile police officers at the court premises to prevent them from destroying vehicles and molesting innocent passers-by.

    Efforts to speak with the Media Assistant to the sacked governor, Mr. Richard Elesho, proved futile as he switched off his phone after the court delivered the judgment.

    Meanwhile, the situation in Lokoja, the Kogi State capital, was calm as at the time of filing this report.

    However, policemen took over the major streets in the capital to prevent breakdown of law and order.

    For the first time in the history of Nigeria’s democracy, a governorship election is going to be re-run. The Court of Appeal in Abuja yesterday affirmed the judgment of the Kogi State Election Petitions Tribunal nullifying the April 2007 election which had returned Governor Ibrahim Idris to power.
    A fresh election is to be conducted within the next ninety days, the court ordered.
    Chief Clarence Olafemi, the Speaker of the House of Assembly, has been sworn in as the Acting Governor of the state – although this may soon be a subject of another interesting development as Olafemi, who hails from Mopa in Kogi West, is also facing the possibility of losing his seat having had his election upturned by the state Election Petition Tribunal.
    He is currently on appeal but if the appeal is decided against him, Olafemi too may have to vacate office while the acting Speaker may end up as the acting governor of the state pending a fresh election.
    Olafemi was sworn in at Government House, Lokoja, at 6.35pm by the Chief Judge of the state, Justice Umaru Eri.
    The Acting Governor promised to “abide by the basic principles of state policies” and vowed to be fair to all the parties and individuals in the state while he holds forth pending fresh election.
    Alleging wrongful exclusion from contesting the April 14 election, Prince Abubakar Audu – who had governed the state from 1992-1993 and 1999-2003 – had challenged the validity of the election at the tribunal, which entered judgment October 10 last year that the election was invalid.
    That prompted an appeal at the Court of Appeal in Abuja and yesterday’s decision in relation to election matters at the governorship level is final.
    The court, however, varied the decision of the tribunal by saying that the tribunal was wrong in striking out the name of Audu from the petition.
    “The Tribunal was in error to have struck out the name of the ANPP (All Nigeria Peoples Party) candidate from the petition. I order that the fresh election shall include the name of the candidate,” Justice Victor Omage said.
    In the unanimous judgment of the five-member panel of judges, the appellate court ordered INEC to conduct fresh election to the office of the state governor within 90 days.
    “I affirm the decision of the tribunal and direct that fresh election be conducted in to the office of the governor of Kogi State within 90 days,” Justice Omage said.
    The panel affirmed the October 2007 verdict of the Kogi Election Petitions Tribunal, that INEC unlawfully excluded ANPP candidate, Prince Abubakar Audu from participating in the poll.
    The court said that Audu was validly nominated by the party but unlawfully excluded by INEC from participating in the poll.
    Meanwhile, the lead counsel to Idris, Mr Yusuf Ali (SAN), while commenting on the judgment, said that the implication is that his client had ceased to be the governor.
    “The next in the ranking of the political structure of the state which is the Speaker will be sworn in, in the interim,” he said.
    “The judgment has extended the frontier of our jurisprudence and has brought certainty in the issues of election and exclusion,” he added.
    Audu’s and ANPP’s lead counsel, Dr Alex Iziyon (SAN), shared the view of Ali that the Speaker of the state House of Assembly would take over as governor till another election is conducted and another governor emerged.
    Counsel to INEC, Chief Kanu Agabi (SAN), who refused to comment on the implication of the judgment, however said that the verdict of the court was remarkable.
    “The judgment is sound and we are grateful.
    Earlier, the appellate court had held that INEC acted ultra vire in its statutory power by excluding Audu from the poll on the basis of an indictment by both the federal and the Kogi State Commission of Enquiry. The panels had indicted Audu for fraud.
    “Judicial power resides in the court of law and not elsewhere. INEC has no power to either remove, reject or penalise a candidate of a political party in an election,” Justice Omage added.
    The panel also dismissed the position by INEC that ANPP, having not participated in the poll, has no locus standi to challenge the results.
    “The right of ANPP to participate in the poll was infringed on. It has the right to sue because whenever there is a wrong there is a remedy at law,” Omage said.
    The security arrangement at the court was very tight and supporters of the two major players in the governorship tussle had a field day abusing one another.
    The former governor was said to be around at the liaison office expecting the outcome of the tribunal while his challenger was said to be in a nearby hotel, also expecting the judgment.
    After the judgment yesterday, President Umaru Musa Yar’Adua directed all relevant authorities to facilitate the immediate swearing-in of the Speaker of the Kogi State House of Assembly.
    Briefing State House correspondents, the Special Adviser to the President on Communications, Mr. Olusegun Adeniyi, said: “As indicated by Section 191, Subsection 2, the Speaker will hold office until a governor is properly elected within 90 days as ordered by the Court of Appeal. President Yar’Adua has also directed the police and other law enforcement agencies to ensure that law and order are maintained in Kogi State in the aftermath of yesterday’s ruling by the Court of Appeal.
    “He advises all those adversely affected by the judgment to accept it in good faith as a necessary aspect of the evolution of true democracy in our country.”
    Fielding questions from correspondents, Adeniyi said ordinarily there would not have been any need for the presidential reaction, “but I have received several queries on what the Federal Government would do because the Court of Appeal was silent on what would happen. They nullified the election but there was no specific instruction on what would happen, and the Attorney-General had to tell me that what the Constitution says is that, when there is a vacancy, and there is a vacancy now, this is what must happen”.
    On why the President was always giving orders after court’s pronouncement, Adeniyi said: “Maybe as time goes on people will get attuned that this government believes in the rule of law, and the rule of law must obtain at all times. We are all living witnesses to what had been happening in Nigeria, we must not give room to speculation, because if we leave things to speculation the situation could actually degenerate to violence, like we are hearing now that the former governor is already giving instructions. We must not allow that to happen. To prevent anarchy we have to nip the situation in the bud and that is what the President is doing.”
    Meanwhile, INEC has said a fresh election will take place within the next forty-five days – latest by March 22.
    The INEC National Commissioner in Charge of Information and Publicity, Mr. Philip Umeadi, told THISDAY in an interview that “all things being equal, we intend to conduct a fresh election in Kogi State as ordered by the Court of Appeal in the next 45 days or so.”
    According to the INEC spokesman, “we also accept the judgment of the Court of Appeal in good faith. The commission has to meet to fix the date of the fresh election.”

    The House of Representatives Committee on Power and Steel has summoned Governors Olusegun Agagu of Ondo State; Liyel Imoke of Cross River State; Danjuma Goje of Gombe State; and Gabriel Suswam of Benue State, who was a former chairman of Power and Steel committee of the Sentate, over $16 billion spent by the Obasanjo administration on the power sector.

    The committee headed by Honourable Godwin Elumelu, also wants past Attorneys-General, Accountant Generals, Governors of Central Bank, Special Assistants to ministers of power, Ministers of Finance, Inspector Generals of Police, heads of the Army, Air Force and Navy, who had served from 1999 to May 29 2007 to appear before it.

    Ministerial depart-ments responsible for power generation in the country including Water Resources Ministry, the Power Holding Company of Nigeria (PHCN), owners of independent power projects, all Permanent Secretaries, Secretaries to Government of the Federation, local govern-ment chairmen and Nigerians in the Diaspora are also to appear before the committee.

    The summon is coming on the heels of the revelation by the Speaker of the House of Representatives, Honou-rable Dimeji Bankole, on Wednesday that $16billion was actually spent by the Obasanjo admini-stration on the power sector rather than $10 billion.

    Bankole’s revelation was contained in a statement which from his office which contradicted President Umaru Yar’-Adua’s statement to a World Bank team that a sum of $10billion was expended by Obasanjo on power sector without any result throughout his eight-year tenure.

    Hon. Elumelu, while addressing newsmen, vowed that his committee would not shy away from its responsibility to summon any Nigerian connected with the power reform agenda from inception of democracy 1999 to May 29, 2007.

    Ex-Gov Idris Packs Out Of Govt House

    Following the rejection of his appeal by the Appeal Court, Abuja on the nullification of his election by the Election Petition Tribunal, the Kogi State Governor, Alhaji Abubakar Idris, yesterday packed his personal belongings out of the Government House.

    P.M.News gathered that aides of the former governor were busy throughout yesterday packing out furniture and other personal effects of the sacked governor.

    More than three lorries were sighted at the Government House, loaded with belongings of Idris.

    The former governor, who was spending his second term in office before his removal yesterday, had immediately after the appeal court rejected his appeal, ordered his aides to move his belongings out of the Government House to enable the Speaker of the State House of Assembly turned acting governor, Hon. Clarence Olafemi, move in.

    The state Chief Judge, Justice Umaru Eri, yesterday swore in the Speaker as the acting governor of the state following a directive from President Umaru Yar’Adua.

    P.M.News gathered further that the deputy governor of the state also packed out his belongings from the Government House yesterday.

    Investigations revealed that Alhaji Idris has returned to Abuja to meet with the Peoples Democratic Party, PDP, hierarchy to discuss the coming election scheduled to take place in the state within 90 days.

    P.M.News checks around Lokoja, the state capital, revealed that policemen have been deployed to major streets to forestall violence as a result of the Appeal Court judgement.

    Attempts by undergraduates of the state university, Anyangba, to demonstrate was quickly nipped in the bud by the authorities of the school who shut it and sent out the students.

    Civil servants in the state were also said to be staying indoors for fear of violence in the aftermath of the Appeal Court ruling.

They are our brothers, sisters, fathers, mothers, cousins etc. So you ‘ll end up having to kill all Nigerians in fact! The culpability of non-politicians, i.e those not taking part in active politics, emanates from the fact that we allow those involved directly in politics to ride roughshod over us. State government across the federation announce billions of naira in budgets every year, budget of progress, budget of this and that, but you don’t actually see any sign of these colossal amount on the ground. So please it’s not just the fault of the politicaians, the led are to blame as well.

Nigeria is a complex set up and when the led read of the horrors of revolution and uprising e.g. Kenya and Liberia, they think twice and most are hoping this would be a last resort. Also Nigeria has not really been involved in the kind of Uhuru etc movements that countries like Ghana, Kenya, South Africa etc to mention a few had to go through to be liberated, hence we the people are averse to bloody warfare which will only bring Nigeria down, albiet could still be the end solution. Even if peaceful protests are organised, the government will clamp down on this or be heavy handed and the opportunists could make nonsense of this. Slowly but surely, the people are saying no, and soon will be saying enough is enough. For example, what do you think will happen in Ondo State if the Tribunal dont deliver the right judgement and hand back our stolen mandate. Anyway, I know they wont for the people i.e. the led will react in ways never known in Nigeria, This is why patience could still be a virtue. We are all watching while waiting and above all praying. WE ARE ALL THE LED COLLECTIVELY. So let us wait and see. Yes Nigerians love life too much to waste it, but this does not mean at the rate things are going that, just as we have the militants in the South South causing mayhem, this could not be the case in other regions. God will deliver us without bloodshed I pray.

    I think a people’s worldview is a crucial dynamic in the progress a society makes socially, politically and economically. Our values and cultural orientation sadly conspire to ensure that we are a basket case in all indices and yardsticks availabe in measuring the success or otherwise of nations. I am not going to bore people with all kind of sociological theories but suffice to say that when we are faced with one problem or other, individually or collectively, our natural instinct is to withdraw into our shells and summon God to bail us out. There is nothing bad in this per se, but I believe human beings are the crucial lychpin in this scenario. Fatalism kills and render a nation that would have been more vibrant an object of fun with the appelation ‘banana republic’ becoming a necessary tag.
    I am no hoping for the ongoing tribunal election to go in favour of the incumbent, but if it unfortunately does, our natural instinct will kick in again. There has to be a point where we say categorically that injustice should not be allowed to prevail.

    True Say TFRIOM, first the people tend to summon God to bail them out of problems mostly based in their FAITH and belief in Him. This is for starters, this is correct and this is good. But then the people are aware that the common saying goes, Heaven Help those who help themselves, hence the need for pro-activeness in the people’s thinkings and reactions. Natural instincts soon turn unnatural if it is allowed to accept the unacceptable at all times, and that point in time you rightly mentioned in your comment, where a categorical no to injustice and looting and flagrant abuse of power, albeit slow in coming, is now at hand. What needs be done will be done, in spite of our seeming complacency.

    Mr / Madam Omotaylor, I hope you are right in my response to the posting about i.e that ‘what needs to be done will be done…’. I honestly really think it’s about time we took our destiny into our own hand. I am glad you referred to our seeming complacency, which is slowly killing us. I repeat again our actions only will deliver us from the shackles of oppression. In other words, change does not happen by accident, you don’t stumble upon it.
    By the way, there has been a dearth of news on the tribunal proceeding. Will people who have the opportunity to know what is going on kindly update us. Kind regards

    The court have not been able to sit last week due to the strike action I believe and hopefully they will resume this week, if they have not done so today. Mr T/A, yes yes I agree that our actions are vital to our deliverance. It doesnt have to be bloody/messy for starters. What we all are doing, voicing out our disdain and disgust, following up on news, sharing and caring and not getting soaked into the environment of covert oppression and lies are part of positive actions that will surely take us to freedom. We are all crying freedom in different ways and violence should only be a last resort if all else fails. Even for the wicked and rogues, we pray for a change of heart and if not we pray for their shame and believe you me, the same God that shamed Abacha, that is shaming and exposing OBJ to the fullest, is in absolute control and will give us a break. Patience is a virtue, and our patience will be rewarded. The Tribunal had better be honest and not cause chaos in Ondo State, for the people have been fooled enough and are not ready to go on being treated as fools. This is why when I read all the sychophantic and falsities from the present regime, I shake my head in disgust, for I wonder who is fooling who. If you follow the Obama campaign in US, you find that people dont buy the untruth and even in Nigeria (yes this 3rd world country), the people are not stupid. A few greedy and corrupt ones think they can buy their way through but by jove, they have failed.

    Strike is off and mimiko filed today to continue sitting tomorrow, but if the swearing-in of the appeal court judges should interfere, then sitting will not be until next Monday.

    The Judicial Staff Union of Nigeria (JSUN) yesterday suspended its week long strike action embarked upon to press home demands for improved conditions of service.
    The decision to call-off the industrial action was arrived at after a one hour meeting held with Hassan Lawal, Minister of Labour with Adams Oshiomhole, former president of Nigeria Labour Congress (NLC) intervening to get the workers to conceed to Federal Government’s request and allow peaceful negotiations.to commence next Tuesday.
    Addressing newsmen after the parley with the union, the minister said all relevant government officials including Attorney-General of the Federation (AGF), Secretary to Government of the Federation (SGF) among others would be adequately represented at next Tuesday to commence negotiation on the demands of the workers.
    The minister who lauded the leadership of the union and President Umar Yar’Adua’s commintment to the rule of law assured them that none of the workers who particpated in the strike would be victimised.
    “We are in a democratic rule and the constitution of F ederal Republic of Nigeria is operational. The freedom of association, movement, freedom to hold opinion and expression are so enshrined in the constitution and I believe nobody would victimise anybody because they have gone on strike. Not under this administration,” the Minister assured.
    In his remark, the former NLC boss lauded both the Minister and leadership of the workers for reaching a compromise to end the strike.
    He noted that the week long strike has greatly paralysed the nation’s judiciary even as he assured them that the present administration would stand by whatever agreement reached during the negotiation.
    “Federal Government is willing to enter into constructive negotiation and weigh demands of the workers going by the comitment demonstrated by the President Umar Yar’Adua’s administartion in the past.”
    He explained that the workers at the round table meeting had agreed to call off the strike adding that negotiation would resume in earnest on Tuesday with the relevant authorities.
    “We need time and conducive environment for dialogue to take place. Your members who are having reasons to doubt will see it when negotaition resumes fully.”
    While speaking, Usamatu Amin, JSUN national president directed all the striking workers to resume work immediately as from today (Thursday) even as he assured that none of the workers would be victimised by anyone for participating in the industrial action.
